Parking Ticket Help
Discussion
Hi All,
I wondered if i could have some opinions on a parking ticket i recieved on the 9th July. I am disabled (Cerebral Palsy) However, I am not one of these people with a disabled badge that will abandon the car anywhere and throw the badges up. I have parked here for many years since i passed my test 15 years ago, and this is the first time i have been ticketed in this location!
I was parked in a very small pedestrian zone round the back of a church, where the small road is there to allow cars to access the small church carpark around the back of the church. Also, the road is actually next to the old county council building (hence the 2 marked disabled spaces), but the building is no longer in use as the county council have moved into new offices.
Both disabled spaces were taken, so I parked infront of the disabled cars, as i have done in the past. There is no double yellows, I wasnt blocking anything or anyone as i was parked inline with the other cars anyway.
This is how i was parked:

Now i had removed my disabled badges and ticket from my windscreen before i took this picture but my badges were clearly on show and the warden would have seen them when he ticketed my car.
This is the sign on entry to the small pedestrian area:

This was a copy of the ticket i recieved:

I appealed explaining the situation and the sign, which says "disabled at anytime" so Ive never worried about the loading restrictions (I wasn't loading anyway) but i have been sent this letter back:

The letter says no cars between 10am and 4pm, but the sign states "disabled at any time"
The two cars behind me displaying disabled badges were not ticketed.
Would it be worth appealing this any further? I realise there are loading restrictions, but i was parked under the "disabled at any time" part and believed i was parked OK, as i have parked here many times over the past 15 years when visiting the bank.
If i pay within 14 days, its £35 (which is a lot for 5 mins parking!) but if wish to appeal any more, they will serve a notice to the registered keeper after 28 days, after which i have to pay £70 or appeal it further.
Ive had tickets before and paid straight up, so have no problem in doing so if i'm in the wrong, but i always believed from the sign, that i was parked in the right.
Thank you for any opinions
Cheers
Jim

I am sorry, but you are misreading the sign. It says "to use parking place and for loading". You were not loading, so we need say no more about that bit of the sign. You can park at any time (using your disabled badge) if you park in the parking place. You parked outside the parking place. The Council could (maybe should) have cut you some slack, but it doesn't have to.

Thank You Breadvan. Should I just pay up the £35 now then?
I actually saw the warden walking around, but as i thought i was parked OK, i didn't worry about it!
Grumpyscot: The no waiting cone is the other side of the wall in the church car park (or bit of grass that doubles as a car park, which is controlled by a locked barrier, so nothing to do with me

Nuzzies! Enjoy your cool car!
Thanks
Despite my love of Honda VTECs (ive had 4 now!), this is the car i have kept the longest! Ive been to Le Mans in it numerous times, used it to carry pretty much anything and everything, and its gone wrong twice in the 4 years ive had it (just snapped alternator belt and leaky brake master cylinder!)The thing wont die and has turned me into an old volvo fanboy! I should really hand my pisonheads card in and sign out

I was hoping breadvan would reply as i appriciate his knowledge.
I'm sat debating whether to send them a letter or just pay. its not the money that narks me, but the sign isnt clear and they have ticked me on the basis of the loading restrictions, which aren't relevant to me as i can enter anytime and there is nothing to say i have to park in a marked bay.
I have 14 days from the 16th to it might be worth a letter before i have to pay the £35

Is it not also part of the general Blue Badge scheme that parking is not allowed where/when loading is prohibited?
Where can I park? Eligible Blue Badge holders, carrying and displaying a valid badge correctly, may park:
• for up to 3 hours on roads where waiting is prohibited, such as single or double yellow lines, unless the signs say 'no loading or unloading'
but the sign doesn't say no loading or unloading

James, do not be led into nonsense by the loonies at that peepipoo nuttersite. The sign is clear. No harm in a letter, but when push comes to shove, pay up rather than waste time on arguing the unarguable. If you really can't afford 35 quid, then maybe we can have a whip round in honour of your fine Volvo shedding.
I'll pay it. I can't be arsed with the hassle! Although i would have liked to fight it more because there is arguments on both sides i suppose.
There are double yellows up until the first parking bay in the picture with the sign on. The double yellows are very faded but in any case, disabled can park on there!
A bit miffed but its a lesson not to park there again unless the bays are free! I was arguing on priciple rather than the money aspect, but i suppose its better to pay up rather than appeal, lose and be faced with double the cost!
Narks me that i was there for 5 minutes! £7 a minute to park. Narks me even more that the building isnt even being used anymore so the loading / waiting thing makes no odds
