Hi PH.

So, I parked my scooter in the usual parking bay marked for Solo Motorcycles Only. I pay weekly by text, paid yesterday.

So far so good. I return at 2pm to see that my bike has been moved into a residents bay and subsequently ticketed. Look around and see several removal firms working at the large house opposite my office. Start asking the usual questions and it seems my bike has been moved by two of the removal men who have since departed to make space for them to load their van more easily.

There are a number of vans/companies on site and no-one seems to want to tell me who actually moved it - lots of shrugging of shoulders etc.. Talk to management company of the property - not our problem etc.

Now I accept that at the end of all of this I will probably be paying this fine. I shouldn't have to but I probably will have to. Are there any avenues I can actually pursue here?

Thanks in advance.

probably and sadly not...
other than finger-printing the vehicle / finding CCTV footage - if everyone denies they were at fault, it is difficult to find anyone else responsible...

I think this comes into one of those costs of life which are unfair, but happen

I've never understood the mentality of the people who think it's ok to sit on or move a motorcycle without the owners consent.

They'd never consider doing it with a car if the windows or roof was left down.

If you've paid for a weekly ticket and clearly have no intent to park irresponsibly it might be worth appealing it? Did you get pics of where they moved it to, showing the vehicles that wanted easier access?

Can't be the first case of a motorbike getting shunted from a marked bay by some numpties?

There's probably no legal basis for a successful appeal but they may take pity on you!

I don't know how widespread it is, but I was pleasantly surprised to discover (while on jury duty) that in Winchester motorbikes can park in resident's bays without needing a permit.

Wouldn't say "never" - I've seen cars moved several times by bouncing or dragging them for various reasons.

4 of us lifted a mates nova and carried it to another parking space to confuse him, it was funny to se him puzzled, then worried, then puzzled again when he found it.
Not as funny as when the pisshead up the street was driving while on a ban, and he went out and bought a tidy xr3. One of the lads took a police aware sticker from a crashed car in a field and stuck it on the xr3, when the owner went out to it he saw it, turned white and walked away, and he sold it for buttons just to get rid of it in a hurry. We ripped the piss big time when we heard.

This is the route I would appeal on. I would show your history of paying for and parking in the correct place and then point out what was happening and why your bike was moved.

If the first appeal fails, you'll need to gather some evidence for a subsequent appeal!

Try posting this in biker banter wink

On a more serious note, unless you can prove that you didn't park there, it'll be a ball ache to get it sorted.

Thanks all.

Adrian E - have appealed on that basis. Warden took pics of the position it was shunted too, even the most blatant of ticket dodgers wouldn't leave a scooter there! Suspect I'm shafted either way.

Cheers.
