Hi All,

Strange one.

I got a letter from a debt collecting agency for an unpaid fine of £80 from the DVLA from unpaid vehicle tax on May 6th.

I sold my vehicle on Friday May 1st, i put the docs in the post that day as usual.
Cancelled my direct debit for the tax.

I called the DVLA and mentioned this to them and also asked why it went straight to an agency instead of me being advised.
They were no real help at all, they said i need to prove i didn't own the car then, they said the car is my responsibility until they receive the documents for change of ownership, how would i be able to keep tabs on a vehicle that is not in my possession? I advised on the registration documents i sent back they will be dated 1/5/15 BEFORE the date of offence.

I spoke to the new owner to clarify it was May 1st and yep it is.

The debt collecting agency were not interested in this as they just want their payment, they have put it on hold for me as the DVLA said I need to write to them to prove I did not own the car.

Anyone else had this happen to them?
I have typed up a letter and put all the information I have in and have sent it off registered post.

Has the new owner got a V5c for the car?

If they have what's the date of issue on it?

Did you pay for any tax for the month of May? Or did you only pay up to the end of April?

Given that you sold it on the 1st of May you still owned it for part of that day and therefore you would have had to have it taxed.

Yep the direct debit had come out for the month of May.

The new keeper got the V5 with 1/5/15.

If I'm at fault i don't mind paying but for once i don't think I am in the wrong, i've sent a letter with all the info in it so will see what happens.

If you send them a copy of the new keeper's V5 with the date they're dead in the water biggrin

Which is why I asked.

1st of May? How amazingly fortuitous that it was the beginning of the month and not say the 17th of April.

I think you've tripped yourself up by being too clever trying to avoid the "extra" months tax

I don't see what you are getting at.
I sold a car on May 1st?!

Why have you quoted an old thread? That's got nothing to do with this thread or the vehicle in question.

I don't think you read it correctly, I'm not trying to avoid paying a fine, if I'm responsible I'll pay it but I assume your just trying to be an "internet smart " going by your other posts on here.

Did they refund you the May payment?

I'm pretty sure I got a small refund of some sort, I'll need to check my online bank statement actually.

If they did then they have acknowledged that someone else was responsible for the road tax from 1st May so how can they claim money from you?

If they didn't refund you then they have had payment for the 1st May from you so again how can they claim more from you?

So whichever way they appear in error trying to claim anything more from you.

You sold your "summer car" on April 17th. Did you sell another car on May 1st? Did you have any problems with the car you sold on Apr 17th?

And I may be a '", but I'm neither incapable of using the correct version of your (sic), nor hiding behind a keyboard, using words that would see you in bother if you used it to most people's faces.

Now open your chequebook and pay the fine.

Yes I did sell another car on May the 1st, no problems with the vehicle I sold in April that I'm aware of, i still see it knocking about with the same owner wink I'm lucky enough to work hard and own a fair few nice vehicles.

And the words that would see me in bother using to someone's face. I would have no problem in having a chat about this in person.

Your contribution to this thread was pointless imo. I've had a read of a few of your post's and they are generally just arsey comments wink. What did you think the outcome of your post would be?

I don't have a chequebook to open.

Then you've had all the answers you're going to get. You say you've proof that you paid for May in full and yet they're charging you for non-payment in May.

One of you is wrong and it sounds like them from what you're saying (I bet it's by though). As such write to them instead of writing on here. It's quite easy to do.

Pop down to any trackday / race that I'm doing from Feb next year and call me some names there sweet cheeks. I'm easy to find as I usually post which garage I'm in at which circuit.

Back on track, there have been other cases where a DD has been cancelled by the seller and the seller has then found themselves in the OP's position. Leaving it to DVLA to cancel the DD then receiving a later refund doesn't apparently generate this issue, which is a point to bear in mind for the future.

And I would expect, in this case, that DVLA will take it all the way to court if the OP doesn't pay up... Once there, the OP will spend all morning in the waiting room with the prosecutor sat opposite glaring & scowling at them - only for the case to be withdrawn just as the case is called.

If this does get before the mags, the OP's evidence seems to be solid and (s)he can ask for costs after pleading not guilty and being found not guilty (no costs awarded for travel if the case is withdrawn as above at the last minute, though, as I expect it will be). It is a charade.

And yes, this has been a cringeworthy thread vomit .
