1st time been caught speeding, help please.
Discussion
Been driving for 19 years and on Sunday got caught out by a hidden camera van. I say hidden, but it was over a brow of a hill so couldn't see it until I was almost on the brow.
It was on a dual carriage way with central barriers, on a Sunday morning, road was completely empty, I received the letter, 58mph in a 50 zone......
I'm so angry, Is there any grounds for appeal, or have I just got to except the fact that I was in no way a danger to anyone, anything, and just pay the £100 fine, except the 3 points, and get ram rodded by my insurance for the next 5 years......

You will got nowhere with an appeal. You admit you were speeding after all!
I had exactly the same thing - my local dual carraigeway changes from NSL to 50mph on the brow of a hill (the A322 from Bracknell, heading towards the A30 bridge, for any of my local homies) and at the point of coming over the brow i was doing 75. Of course, at the NSL no one would bat an eyelid, but the crafty PoPo were the other side of the brow pointing their camera up hill and catch me doing 75 in a 50... at 50% over the speedlimit i felt lucky to only get 3pts and £60, though was also annoyed because i didnt see any children playing in the middle of the deserted dual carriageway...
Dont worry about the insurance, any premium hike will be minimal (if at all)

What would be the basis of your appeal? I don't want to come across as one of those holier than thou 'told you so' types, but speed limits don't suddenly cease to apply on Sunday mornings or because there isn't any other traffic around. 58 in a 50 (so probably at least indicated 60 on your speedo) should mean you get to go on a speed awareness cause and not have to take the points, so you'll just have to take it on the chin.
School of thought 1: What if there had been a crocodile of schoolchildren carrying kittens crossing the road, you also wouldn't have seen them.
School of thought 2: You might reasonably expect the road to be NSL = 70 mph, is the signage adequate and conforming to all the regulations? That is likely to be the only possible grounds for appeal with potential for success.
School of thought 3: It will only be a SAC. Life's too short. If you don't get any more points for another 19 years, etc.

The over zealous attitude to speed enforcement currently de rigeur virtually everywhere means that so many people have convictions that their impact as regards insurance has reduced dramatically in recent years.
None of the 3 policies I have (2 private, 1 business) load for the 6 points I currently have from 1 offence.
As said, you'll probably waste half a day of your life on a SAC and £100 ish and get no points anyway.
Another PR disaster for the Police, whether they are directly involved or not (which they usually aren't these days).

It's just massively annoying, I had returned on the Friday from a Nurburgring trip, having covered 1300 miles, across 3 countries, not seeing a single police car, using the autobahn's, beautiful scenery and lovely nice people.
To return to getting caught by a camera van, the wife getting shouted at by a random stranger in Whitstable, calling her a d
head because we had parked legally on a single yellow band (allowed on a Sunday, he obviously had no idea)and receiving a letter from our beloved council telling me I have to pay £500 to have a tree surgeon trim our tree that's causing no harm to anyone either (a local groundsman had been on rounds apparently).... lived there for 10 years and it's never been an issue before.
Just hating Britain currently.
I will call them up and try for one of these speed awareness courses, I'm sure it'll be riveting, maybe I can tell them about all my track experience's and reasons why I don't speed on the roads, pay high insurance premiums because of all the other road users that don't have valid insurances or licences....
AArrgghhhhhhhhhh, sorry rant over.

You could try telling 'em that it wasn't you driving? Didn't work so well for Chris Huhne, though.avalaugh said:
or have I just got to except the fact that I was in no way a danger to anyone, anything
Oh, they're charging you with dangerous driving as well? I thought it was just exceeding the speed limit. Yeh, you've probably got a good defence for that one, so long as you plead guilty to exceeding the speed limit, because they've got you on that one.avalaugh said:

No, they come as an integral part of the fixed penalty, you can't have just the fine without the points.avalaugh said:

Now you really ARE living up to your user name.avalaugh said:

Dover's that way. You've got 27 other countries to choose from without having to worry too much about paperwork.avalaugh said:

Don't work like that. They get to choose.avalaugh said:

I think they've got a photo that says otherwise.Edited by TooMany2cvs on Thursday 15th October 13:41

What are the guidelines on being offered a course instead?
Your speed under speed limit +10% +9mph.58 in a 50 is well within SAC levels. It's even bordering on just plain unlucky to be over the prosecution threshold at all. 56 or 57 detected and nothing would have happened.

Except for all those who support it. The IAM conduct surveys about attitudes to speed cameras and find most people support them. Just because you think the way you do, doesn't mean others do. avalaugh said:

TBH I did one and did come away having picked up a few tips I'd never considered.
(Also you don't call them up and ask - it has to be offered)
