Just an Insurance question anyway because mine couldnt give me an answer yet. If you have a claim lodged against you that is now closed (2 years thing) can you request your NCD to be returned as nothing was ever paid out.

Not sure what you're asking.

What "2 year thing"?

What NCD has gone missing, how many have you got and what do you want back, as normally, you lose two years NCD, so will have recouped that now anyway? Anything over 5 years (as a general rule to appease the pedants), are really no more than claim free years, as the max discount tends to be earned in those 5 years.

You can ask, i don't see any reason for them not to, getting the difference on your premium back would probably be a little harder, especially if you changed companies mid way, but it's possible even if you did, especially if you told them the claim was still pending.

I am afraid loon is off on a strop, might be a few more weeks till he's back

sorry im not good at typing my thoughts. I rang my Ins co to find out how much the claims were on my insurance (well how much was paid out) both of them have now been closed on account of them being older than 2 years (jan '13). I discovered that in one of these claims nothing was ever paid out (the 3rd party insurance hadnt processed their end in time) so what im asking is as nothing was paid out does this now mean im entiled to the 2 years NCD back ( i didnt claim for my own vehicle)

I'm not on a strop, but I am avoiding here as it is tedious reading the same old crap over and over. A cursory glance at today's half term specials are pure quality.

I've replied to this out of courtesy, as it's been directly addressed to me.

I'm still not sure what you're asking though.

There's no two year rule around closure and there's no limitation after two years, so either claim could reopen for injury (to Jan 16) or property (to Jan 19). I don't understand the comment around the TP insurer "not processing their claim in time", they've still got plenty of time to do it.

If your insurer is satisfied that no claims are going to be made, then they can reinstate your NCD for that claim if they want to. It's their choice, as NCD is a marketing gimmick gone wrong, rather than something mapped out in law or regulation. Just ask them if they will. If they won't them there's not much you can do. The thing that's confusing me is that even if they do, then it's effectively pyrrhic. You'll spend a load of time chasing two years worth of NCD (or claim free years), that you've already earned back in the past two years anyway, or at least will have at the end of this policy year.

I think I follow you... in regards to the third party the original claim went 50/50 and a check was sent to the third party for half of the costs. this cheque was apparantly never cashed so was ultimately cancelled. as for the closed after 2 years thing that might just be something im confusing as the insurance company said they had closed the file on the claim. I guess what I was asking was am i within reasonable grounds to ask for a re-enstatement meaning i'll have 5 years or am i ultimately barking up the wrong tree?

Technically they have paid out. Just because the TP failed to cash the cheque is irrelevant, as they can ask for the amount again at any point up to limitation. They won't reinstate your bonus on a technicality like that.

IANAL

I'm surrounded by the buggers and seem to spend my life talking to them in one guise or another, but have no legal qualifications of my own.

And I'm very proud to say that last bit too hehe
