after a property litigator / solicitor for parking dispute
Discussion
afternoon chaps, I'm after a recommendation for a decent property litigator or solicitor to deal with a parking issue I have with one of my neighbours.
In brief: there is a shared area between our three houses and on that area is two parking spots at the back, but the neighbour at the other end keeps parking half across my access to my spot meaning half the time I cant physically get my car in there. deeds clearly state no vehicle to be left parked outside of allocated spaces and show the 'issue' houses' parking to be where they have decided to have a courtyard garden instead. 'issue' house is rented out and the tenant is being a knob, letting agents are w
kers who wont acknowledge the fact they mis-advertised the property even after I supplied them with required paperwork/proof etc, and the landlord agreed verbally in person a few months back to change it so the tenant would park in the courtyard bit instead of restricting my access, but she hasn't got in touch and I have no contact info for her.
At the point now where I have been extremely tolerant and amicable about it for several months (i've had 2 bereavements recently so I've not been in the mindset to deal with added hassle and to allow time for work to be done)
wanting to make it official now, so after someone who can get it sorted for me, and I know theres plenty of experience and references on here for decent people if asked :-)
hope to hear something good back from you chaps, any good news coming my way can be repaid with a hand doing pretty much anything as I'm a mechanic/ very experienced diy bloke by trade and experience..
cheers fellas :-)

Excuse my ignorance, but even if you prove the legatee of something, which will take time and cost money, you then have to enforce it... So you get everything drawn up, approved by a solicitor t
tface can still just park there, you will be in the same boat as you are, but with another piece of paper to point to...
What happens when you ask them to move and point out issue to them?

Are you able to block the tenant in at all?
Could you not park in the alternative parking area?
I say this as entering into a formal dispute with a tenant is heading for a whole world of pain and misery.
Otherwise, any competent property lawyer will be able to write a s
tty letter for you. But if the tenant is a true knob it won't get you anywhere.

But if the tenant is a true knob it won't get you anywhere. the tenant seems like an alright lass (ish) but she has said she wont stop parking there till she is told otherwise by her landlady as her tenancy agreement is "legal" (which is factually incorrect as the lettings agent said there was parking where there wasnt). its more a case of it needing to be got straight with the owner who then should instruct the tenant to park elsewhere as i dont want an ongoing issue as i have paid my very hard earned money for my house and parking and not willing to get mugged off by some bird who has her head shoved up her arse so she can rinse a few more quid off the tenant (thats the real reason she wont do anything about it im 100% certain)
perfect example being the other night i was properly blocked in and needed to get on the road sharpish (im military and on call a lot of the time) and nobody answered her door for a good fifteen minutes or so after MUCH loud knocking and door bell ringing. then got back to find i couldnt get my car in to park up.
my apologies if i rant a bit, its a proper pain at the minute that i could much rather do without.

cant park in the other space as thats my neighbours (the one in the middle), and cant block her in. ive been massively polite and civil about it for months now but sadly it seems like tenant is 'one of those types', the landlady is a bellend, and the letting agents were damn close to getting a beating for their rudeness and sheer cheek after being sent official and clear docs
This might not work if you have limited space, but before I bought this house the previous owner used to do the same to our neighbours. So one day our neighbour just dug a small narrow tench between the spaces and put plants and posts into the trench. Problem solved.
After we moved in and proved to be rather more reasonable said trench was filled back in :-)

in the pics I uploaded (done using paint so not exactly amazing lol) the tenant continually parks where ive put the red box and ive tried to show the path I have to take with the blue arrows. I need to reverse in as its impossible to do forwards and even if I could id never be able to reverse it out again. looks spacious on the pics but keep in mind the neighbour from "plot no.2" usualy has his car parked in his space (cracking bloke so got no issues at all with him). result is having to reverse round a sharp acute wall, trying not to reverse into her (already battered to f
k) car, then shimmy back and forth for five minutes or so, then reverse parallel park into my space whi8le trying VERY VERY hard not to catch the front of one car or the back of the other. all in all, a bloody nightmare as i'm sure you can imagine.
in one of the pics ive also put the bit just above where the tenant parks a green line, this is where a fixed fence is currently fitted, and this (should) be where the tenant is able to park the car so nobody gets obstructed in any way shape or form and all is tickety boo.

Could you get passed if you moved the bins or is it a problem with the perspective of the picture?
perspective of the picture, ive tried it by moving the bins and its still tight as a nuns cu*t to get the car past without coming perilously close to catching the other two carsForums | Speed, Plod & the Law | Top of Page | What's New | My Stuff
