Mobile home law
Discussion
Hi,
My dad was recently diagnosed with Parkinson's and has become very unsteady on his feet.
He lives with my stepmum on a mobile or park home site and the path to their home is very unsafe, with uneven paving slabs along its 30ft length, in addition to being unlit and very poor drainage.
Does anyone have any information as to what the sites responsibilities are with regard to repair and maintenance? The guy in charge of the site is being a complete dick in as much as dragging his heels to do anything about it.
The council have been to take a look and said they have to repair the path but the maintenance guy has said "I decide what gets done on this site"!
I'm due to go down there in a couple of weeks and would like some idea of what their legal responsibilities are.
Any info is much appreciated.

as ever IANAL
I'd expect if they are providing a path then it should be safe and the provider should be liable if anything were to happen because of the defect.
Its up to the owners to decide whether they'd rather leave it as is and risk someone making a "where there's blame" claim when they trip/fall and injure themselves or spend 50p and make the path safe.

Perhaps but it is the council who give them their operators licence. They are in a very dodgy situation insurance wise if they do nothing about it and something related happens. In any event is the maintenance guy the site operator? The council have been to take a look and said they have to repair the path but the maintenance guy has said "I decide what gets done on this site"!
Hi,
Thank you for all of your replies.
I've now seen a copy of an email from the council to my stepmother which states that the maintenance guy, whos's employed by the owners, was given until the end of last year to start the repair work and if not, a notice to prosecute will be served.
Emails have now been sent to the council to spark them into life as nothing has been started at all. We' ll see how it goes from here.
