Hi, I recently picked up a charge notice for £50 for parking in the entrance of a full car park. It was a bit iffy but I had a catch my train to work. I assumed it was 'road' rather than private property but I was wrong.

Anyway, admission of guilt aside what is the latest on enforcement of these notices? All posts I see are from many years ago and advise that the driver has no legal responsibility to identify the driver and as such they can be ignored. Is this still the case?

First of all, and it costs you nothing,get onto pepipoo.com, as if it was a railway car park it may be covered by railway by laws, which are a diffrent kettle of fish to the normal 'unsolicited invoice' you have received. If you are honest with the guys on there, they will be honest with you. Firsdt o ll do not reply to the PPC saying you are the driver, otherwise, it is hrder to fight.
So pay up 50 quid now, or spend some time getting honest advice which is correct 99% of the time. It isd your choice. There will be people on hers who, as is their right, dis the site, but i do visit it seeing some of the problems that thes PPC cause. and there seems to be more wins than losses, esp against the PPC, and a quite good rate against Coucils due to their inabilty to get the small print corrct.
so it is your choice,and more importantly your fifty quid. Whatever you do dont ignore it as rules have changed, and the RK can be chased. some do take you to court, but that is a long way off, and letters threatening debt collectors are just hot air as these guys have as much authority as you have in getting cash off of a third party.

You need to be careful of station car park fines as they are often covered by Bylaws not the POFA, so are legitimate fines.

Thanks - I think I'll just pay it. For the record it's a country station and many cars park outside in the street as the carpark is full and being expanded. If I'd parked another foot outside the junction it would have been legal. Nobody was inconvenienced.

Does that apply even if the parking 'fine' has been issued by APCOA?

Well if you have 50 quid to waste then go ahead.......It will cost nothing to check via pepipoo if you have a case where the PPC has overstepped its authority and basically nicked 50 quid off you bty deception

I wasn't necessarily meaning you specifically...

Sounds as though he has already decided.

Pofa 2012 does not apply to railway car parks, even if they are managed by a private company, as it is "not relevant land". No Pofa, No keeper liability.

http://www.legislation.gov.uk/ukpga/2012/9/schedul...

In this Schedule “relevant land” means any land (including land above or below ground level) other than—

(a)a highway maintainable at the public expense (within the meaning of section 329(1) of the Highways Act 1980);
(b)a parking place which is provided or controlled by a traffic authority;
(c)any land (not falling within paragraph (a) or (b)) on which the parking of a vehicle is subject to statutory control.

Nothing to do with the local councils not providing more parking in order to keep the communities and businesses running in the modern day?
If they did this there wouldn't be your so called 'idiots' having to leave cars that inconvenience others.

Looking at the wider picture gives an understanding as to why people park the way they do.

Sure PPCs and local authorities have the black and white nature of the law to hand out when ever they see fit, but at the same time the local authorities are doing little to allow the public the convenience of parking in many locations; and PPCs are there purely for profit, in many cases on the desperation of the motorist in lack of available parking.

So roughly what %age of your typical town would you like to be compulsorily purchased and demolished to build car parks on?

Oh, absolutely. But I think we might not agree on what that understanding is.

I agree. I turned up at the airport the other day and it's much the same story. I was disgusted to find that I couldn't simply leave my car wherever I wanted for free and the cheeky bds who'd built the nearby multi storey car parks expected me to pay to use it.

Cheeky airport authorities applying their black and white powers, whilst I'm expected to be socially aware and act like a reasonable person. Well I'm not. The world revolves around me. I demand certain privileges as my right and anyone who says otherwise is a nasty fascist.

Glad I logged onto pepipoo and listened to their advice, I'm now £1500 out of pocket for what would've been a £40 parking ticket. I'm sticking it to the man and fighting it all the way. I'll keep you updated (actually I won't as I'll lose, but you know wot I mean).

It could have been much worse, you could have seen a small sign as you approached the airport marked "Parking Information" so you stop briefly to read it. It then says "Parking prohibited. No stopping, you are liable for £100 for stopping here etc etc etc" so you drive on and use the multi storey P&D.

2 weeks later you get an official looking invoice with a photo of you stopped next to the sign, reading that you will be charged £100 for stopping...

Dozens of people get these each day. most of these people pay up, thinking it is official.

Airport land is covered under bye-laws, not POFA, therefore the vehicle owner/keeper can not be held liable.

Welcome to the world of "Vehicle Control Services" at Liverpool John Lennon and Doncaster Robin Hood airports.

The latest position is that you'll almost certainly get no response if you ignore the threats of court action (been a while but my last experience with APCOA last year was exactly that), but some folks have defended themselves in court and lost, and therefore private parking co's have plastered their websites with such propaganda to try and further persuade you to part with your cash.

POPLA is your friend; I've recently used them to successfully appeal a ticket. Just challenge the parking co to prove they are allowed to act on behalf of the land owner and see where you get.

The penalties are ridiculous; I used to regularly get these things and ignore it but tend to use council car parks now as they tend to apply common sense in my experience, and if you do forget to pay & display it's £25 for prompt payment which seems fair enough.
