RTC outcome advice
Discussion
Hi All,
a friend of mine is worried about potential prosecution outcome following a crash. Understanding we'll get a few "my friend" responses I can write this guilt free as it isn't me but I also write relieved no one was seriously injured.
My friend is at fault and is not denying liability. It is the first time they have been in this scenario and is naturally very worried.
At the beginning of last week they were driving home when they appear to have washed out on a bend hitting a car in the other direction. Weather conditions were good, dry roads etc. Police/Fire/Ambulance in attendance, no questions raised as to whether they were breaking the limit as they weren't but obviously too fast for the condition/road/turn. Both cars written off, side on side collision with front wing hitting into oncoming cars front quarter before coming to a rest.
No drink involved, no skid marks (not that it matters) but they did brake and ran wide probably with understeer (bend is almost a hairpin).
They are worried about potential outcome, prosecution, points etc. Accepting the fact they will probably get points they are more concerned about losing license.
They are also worried that if asked in for a chat, what to do. I said don't be afraid of making sure you have representation as its not a sign of guilt but its new grounds for all involved and as I am not a lawyer I figured throw it open to you guys on here.
Just to add, all were walking wounded after assessment at the hospital.

My friend done the same thing many years ago. Cheap chinese tyres on the back of a new to him car caused the back end to step out in the rain on a country road. When he hit the car on the other side of the road it was an off duty police officer who called in her colleagues.
Traffic police arrived. Found no contaminants on the road so decided to charge my friend with driving with undue care & attention. It was a NSL road and he was doing about 30mph round the corner. Has done it at that speed many times before in other cars and that's not pushing it at all, just the cheap tyres caught him out.
For some reason the members of the public who gave witness statements said my friend was driving far too fast and the wheels came off the ground with how fast he took the corner.
With all this he got a large fine (800ish IIRC) and 4 points on his license.
Similar accident to your friend but much more unlucky with the circumstances.
