Parking Ticket
Discussion
Dear wise ones
I have been reading the thread about speeding tickets http://www.pistonheads.com/gassing/topic.asp?h=0&a...
I was given a ticket last year.
the claim was that I was parked outside a house that does not exist at a restricted time etc
I appealed stating with photographs that I was not parked outside number eg 56 Hippo street, and proved the road only went up to eg 24 etc.
Proved there was no sign age for restriction etc
They also claimed it was at eg 9.30 (on a bloody sunday!) yet when the car was passed at 9.50 there was NO ticket on it!
After a MONTH (not 14 days) they had changed it to - you are parked on double yellow lines.
(If anyone still has a ticket that states they are being ticketed for being on double yellow lines I would appreciate a picture, I have googled one but no one seems to have one up)
- I understand changing the reason is NOT LEGAL
- I understand IF they had meant double yellow the first time it would have written double yellow, hence a request of what one looks like
The yellow lines I was partially on were incomplete and do not end with a T bar, which I also still understand to be not legally enforceable. Parking there is nightmare, and interestingly the council is adding to the problem that over the last few months have double yellowed NEW sections however declined to maintain other sections!
I have had a little guidance and both of us expected it to be thrown out by now (court case in a few days) all this has been sent including their photographs yet all the faceless people have continued with the process.
Any further guidance to what I have already copy/pasted to take with me, would be appreciated eg the change of reasons, out side a house that does not exist etc ;-) Most appreciated :-)
THANK YOU

What is the relevance of 14 days? You appear to be a bit muddled here.the claim was that I was parked outside a house that does not exist at a restricted time etc

Why is this now the subject of court proceedings? Did you go through the proper appeal process?
- Informal representations
- Rejection
- Formal appeal to LA
- Rejection
- Appeal to TPT/London Tribunals (formerly PATAS) as appropriate.
If not, why not? You need to be aware of the time scales for the different stages as they apply to both parties.
This is not the best place to get specific help re LA parking tickets. Register on MSE and/or pepipoo. You will need to provide more information than you have given here and be expected to have done your homework on the relevant legislation as well.

Someone mentioned they should have got back to me after 14 days but they took a month and changed the reasons why...
Ticket issued
- sent in appeal with photos etc
Appeal rejected and a NEW reason given as to why the ticket was issued
Then they sent a form
- sent in form with previous info PLUS a copy of their photoes to show they were wrong
They rejected this
- repeated reasons why
They forwarded the papers to court
I was sent a copy
They have sent the court date

If it is a LA ticket for a DYL contravention then the process is as I have outlined in my previous post. There are only two ways a court can be involved.
1. You failed to appeal to London Tribunals/TPT (whichever is relevant in your case).
2. You did so and lost then failed to pay.
In either case the LA can apply for a Charge Certificate and if you still don't cough up it can apply to the TEC.
See - https://www.citizensadvice.org.uk/consumer/transpo...
There are clearly choreographed steps to this dance and it's not clear from your posts which ones have been followed or when. On the face of it there might have been an abuse of process. In particular, if the LA has failed to inform you of how to appeal to LT/TPT, and/or has taken steps which have prevented you from doing so that is a serious procedural impropriety and should be brought to the attention of the court. In the meantime I have told you where you should go to get specific help. With a court date looming you need to do this pdq.
Otoh, if it's you that has stuffed up in some way, then there may not be much that can be done to help you.
