Guys,

Looking for some advice related to a traffic offence. To cut a long story short, the Mrs was given a fixed penalty notice the other day for a traffic light offence- Amber lights, unmarked car directly behind her.

As always, I checked over the notice for any mistakes or discrepancies. All of the "filled out" information was correct and valid. However, I did notice something in the small print;

"To accept this offer you must pay the fixed penalty to the Clerk of the Justice of the Peace court at the address overleaf, and deliver your licence and counterpart and driving test certificate if held by you to that Clerk..."

As we all know, From the DVLA website;

"The paper counterpart to a driving licence has had no legal status since 8 June 2015. You should destroy yours if you have one, but keep your photocard driving licence."

From a legal standpoint, the fixed penalty notice is asking me to provide a document which a) has no legal status, and b)I no longer have in my possession.

Surely the police must have a Quality Management department who review all documentation to ensure that it is always kept up to date with current legislation etc, which I think would apply to the above???

Any thoughts?? Is this worth investigating further or will they just tell me to pcensoreds off and increase the fine!!!

It's a nice try, but it won't get you anywhere.

Surely a far better way to deal with this would be to address the fact that going through an amber light is perfectly legal - IF you believe that's what she really did...

OP

Go onto the pepipoo site, they will give you a hand in this, esp as passing an amber light is not an offence

go to pepipoo.com, register and put it in the 'speeding and other offences' forum
Just be honest, there are serving trafpol on there who will advise you , and listen to the posters who have a high post count eg Gan hcanderson, schoolrunmum

Be honest they take a view of pepole who leave bits out. And as runing an amber, if thats what the FPN says, they will tell you what to do. IIRC even redlight cameras give a 1.2sec ggrace after the red before flashing.
It wont cost you anything apart from your time, and as a long term eader of it, is well worth the effort

Ignoring the irrelevant bit about a counterpart driving licence what's an amber light offence?

It's exactly the same as a red light offence, just one that you're not guilty of smile

It's a discrepancy that's been happening for a while... surprised it's still going on. I got caught by the met in 2012ish and had a problem handing my licence over to Surrey for similar reasons - some forces haven't caught up, but it is better to hand the licence in asap.
