I bought my smart phone from carphonewarehouse in December. Brand new. A couple of weeks ago some black spots appeared on the screen. I have not dropped my phone

They have said at the shop that they will repair the phone. The phone will be away for two weeks. They offer a calls and text standy phone while they have mine for repair

This is a huge inconvenience. Am I entitled, under law, to anything more than they have offered?

A phone makes and receives calls and txt messages, why would you be entitled to more?

Struggling to see what else they could do?

A like for like replacement. Smart phone for smart phone sounds reasonable given a phone is used for far more than making calls and sending text messages

That's what they said in the shop too. It hasn't been dropped. There is no cosmetic damage which doesn't prove it hasn't been dropped. But does show it has been used carefully

Anyone know how long is reasonable in the eyes of the law to get the phone repaired? 1 week, 2 weeks, 3 weeks, more..?

IMHO at least the 1-3 weeks you suggest and probably double that. After 6 weeks or so they might need a reason (eg. hardware shortage).

If you want a 24 hour like for like replacement then take out the appropriate contract. I used to have exactly that and used it on a couple of occasions. However as soon as I didn't need it I binned it off... if I'm without my phone for a short while now it's not the end of the world

Claim for whiplash, trauma and anything else that you can imagine. It's a phone for goodness sake.

If it doesn't prove it hasn't been dropped, why would it prove it has been used carefully? Only been dropped carefully?

When you buy a car, do you look for damage? Careful accident damage? PH definitely has an oversupply of stupid pricks

I wish I never asked

What sort of phone insurance do you have OP?

No insurance unfortunately

I'm tempted to buy a new phone and sell this when it is repaired. Might cost me £100-£200 but worth the cost in less hassle

For future, I must sign up to one of those paid for bank accounts that gives 'free' phone and travel insurance. Definitely saves hassle even if it is not free

I didn't think there was a law relating to how long a phone can be repaired. Even if there was, I can't even begin to think how you would apply it. I'm assuming you've explained your needs to the store?

You're entitled to have the use of something you've paid for.

He hasn't paid for relacement cover though. No reason to suspect he was sold a faulty phone, more likely it's been damaged so he's not doing to badly getting a free repair.

After a month of your use then a repair of the phone is reasonable. Anything else is a bonus to you.
