MOT & driving to get repairs.
Discussion
If you have an insured car with no MOT but you know it needs welding to pass one, can you drive it to a garage for repairs? I understood you can BUT.......
1. Does it need to be booked into a garage that is a registered business or can it go to a welder that has a lock up. I assume you would need to be booked in with a time and day to prove your on your way there.
2. As you know it needs welding this would mean its not road worthy so does this cancel out the above.
If this is the case any MOT failure could not go on the road as its not roadworthy.

1) It needs to be booked in.
2) Not necessarily. An MOT failure doesn't mean an unroadworthy vehicle, it depends on the fault.
The booking in exempts you a no MOT offence. It doesn't exempt you from vehicle defect offences.
Thanks for the reply, the booking in part confuses me, If you had a mate with a welder and a lockup/garage on an industrial est but its not used as a business premises can you book it in with him, or does it need to be a fully registered business. 2) Not necessarily. I suppose the other question would be is it a defect offence for having rust holes around 4/5" wide in the inner wheel arch?

See Regulations 6(2) and 6(3) of the Motor Vehicle (Test) Regulations 1981
Great thanks, Doesn't say anything about a registered business, but the repair must relate to the MOT refusal so I will need to get the MOT refusal notice first.(A)
for the purpose of delivering it by previous arrangement at, or bringing it away from, a place where work is to be or has been done on it to remedy for a further examination the defects on the ground of which the test certificate was refused; or
