They're not your agents, they're the vendors agents aren't they? So only interested in doing the best they can for their client, the vendor. Not much you can do except try to contact the vendor direct and do a deal with them.

Scenario:
- We have sold our house
- Our agent informs the vendors' agent that our buyers are yet to complete (not correct)
Can you just clarify this?
Your putative buyers have completed on their sale, but they've not completed on purchasing your place. Have they even exchanged on purchasing your place?
If that contract's not completed, then you haven't "sold" your house. If they have completed, then why aren't they living there yet...?
If it's not even exchanged yet (which would normally include a completion date), then there's no contract to complete as yet - you have an agreement to sell, but no more. Your agent is absolutely correct.

Although not guaranteed that we would have been successful if the agent had given accurate information, I feel that our agent has reduced our chances through their incompetence. Having spoken to them they have apologised but it feels like a bit of a cop out. Is it worth pressing further? Not sure what I would expect out of it?
But you're not asking about compensation. Oh, no. Not for one minute did it even cross your mind.

I`m not, let me say that again, I`m not after compensation - sunk in yet has it!
Perhaps you'd be so kind as to explain what you meant by "Not sure what I would expect out of it?", then, or what you would be "pressing further" for, if not the apology that they've already given.

hombrepaulo said:
Yes we are only 'under offer'
So you haven't sold your house yet, then. Your agent was correct in telling the other agent that.

hombrepaulo said:
but our agent informed the vendor agent that our buyers are likewise 'under offer' when in fact they have completed.
Which doesn't put your putative buyers under ANY increased obligation to buy your house. If anything, it makes them more likely to drop out, since they may well get antsy at any more delays in you purchasing somewhere, and just decide to either stay put in rented or buy somewhere else.

Have you considered letting your sale complete, and moving into rented yourself?

Go back and read it again. The bit you are missing is that our estate told the vendor that our buyers haven't completed on the SALE OF THEIR PROPERTY, when they have. Thus giving the impression the chain is longer than it actually is.
Yes, it does now say that. It didn't when I replied to it, though.

Not that it makes a lot of difference, because you still haven't actually sold your house.

Very true but not really the point, and not one I am contesting.

hombrepaulo said:
Our agent has given false information which may have influenced the decision to accept our offer or not.
And which may not have, but which they've apologised for anyway.

But that apology wasn't enough for you. You want to pursue them further for something, but you're not sure what, beyond the fact that it definitely isn't compensation.

Do you want them to kiss your arse or something then?

They made a mistake, they apologised. Nobody died.

If not compensation, then what?

I`m not responding to anymore compensation accusations or questions as to what I am looking to get out of it. As I am not looking for any personal benefit from this.

If my options are nothing, then fine, I simply wont use that agent in future. If there is something else worth doing lets hear it.
What outcome do you want from this "something else worth doing" ?

can your agents now confirm to the agents of the house you want to buy that your buyers are not in a chain and completed? That will correct the error.

Yes you may have to go into rented to secure your 'sale' as other have said you have not got anything until you have exchanged. So you have not sold your house yet.

What sort of time limit has your buyers given for you to move out?

So accept the apology and move on.

They've made a simple mistake, and freely apologised. You freely accept that it's almost certainly made no difference to the outcome, so...?

Oh, wait a sec...

hombrepaulo said:

Like what? You say it's not compensation, no personal benefit, but...? Do you want somebody to commit seppuku in the middle of the office? Do you want the entire branch to put an advert on the front of the paper saying "We made a minor error with no consequence, but we're all resigning anyway."?

What DO you mean or want, if not compensation...?

But it still won't make any difference, since the other buyer's now proceeding with the purchase, and the OP accepts they were in a better position than he was anyway.

hombrepaulo said:
They have confirmed our true position but it hasnt changed anything.
So they've done everything they can do to apologise and rectify the situation, but that still isn't enough for you...

Moving to rented isnt an option for us.
Of course it is. It might not be the perfect option, but it's always an option.

Thanks toomany2cvs for clarifying.

OP - you do have the option of a formal complaint to the agency for them to investigate and report back. if you are not satisfied with the Estate agents investigation they you can make a formal complaint to the Property Omnibusman. They can make an award if they find in your favour or agree an apology is suitable or not agree with you.

With renting - why do you not feel this is an option for you? Would give you an edge perhaps when making an offer on another property, chain free for you.

Thankyou for another polite and helpful post. A formal complaint seems like a sensible approach, I suppose I just want to know that they aren't going to mess up again, for me or others.

So instead of "sorry", they should have said "sorry, we won't do it again".

I'm sure we'll all sleep a lot better now.

Yep. Looks like hombrepaulo's run off home, taking his ball, and asked his mummy to kiss it better.

<edit>
Hold on, though - there's a LOT more than that missing, and normally the OP would just have "Post deleted" text box. The whole bit where a professional chimed in, somebody did some amateur sleuthing (of the half-arsed variety), etc - and the bit where the OP had an email from the auctioneer on a Sunday PM offering him something that made it all right again - that's all gone, too.

I detect the hand of the mods.
