I am a handyman by profession and was carrying out a job as a favour for an eldery friend who had a flat in a building, his flat number being #214. He gave me the parking remote to enter the garage and I mistakenly parked in space 14, when i should have parked in space 11 which is the one designated to his flat. I had been there on a couple of occasions before but on that day my memory escaped me. Upon return from the job that took approx 30 mins I saw a parking ticket on my windscreen. I decided to ignore it thinking that they are hardly enforced but today I received a claim for with £151.74 claimed, court fee £25.00 and legal representative's cost of £50.00 - total coming to £226.74

Gladstones are the solicitors.

In hindsight i regret not informing them of my mistake in parking in the wrong space which may have led to the ticket being waived.

I have acknowledged service of the claim form today and am hoping that some of you can provide me with some advice on how to draft my defence.

This is a general motoring forum so not the best place to get help. Go to here and here.
Do some homework on both before posting, in particular the Newbies section in the second link.
Also perform a search using the name of the PPC which issued the Parking Charge Notice.

Does it make any difference which space you were parked in when the parking company doesn't have your reg number?

Parking company doesn't keep a record of registration numbers. They just administer illegal parking. As an owner of a space you can choose whatever park to car on your space.

£151.74 is somewhat excessive and would be hard to justify I feel.

What did the signs on site state?

So the owner of space #14 shopped you during your 30 minute stay? The parking enforcers don't know your registration and no-one else would know which vehicle should park in that space.

Yup, seems like that is what has happened. Having been back again recently on a couple of occasions I have seen that no one parks in bay 13 so 14 probably didn't like that.

"Centrally" laugh You pay to rent a space and you can't decide which bit of it you will use!

If the stated charge is £100 why are they claiming £151 plus costs?

That signage is not compliant to form a contract with the driver, and Ace Security are reknowned for underhand tactics. Their Notice to Keeper will not be complaint to enforce keeper liability, and on that basis alone you will be able to get it overturned by a judge.

Have a read of this - http://parking-prankster.blogspot.co.uk/2015/05/ac...

You should also ask the Court to transfer the case to YOUR local County Court. More convenient for you and expensive for them to send representation.

Good Luck!
