Temporary limit exceeded
Discussion
I tried search as this won't be the first time it's asked but didn't get relevant results - I've been asked advice about notification of exceeding a temporary speed limit. Apparently it was empty motorway, M25, middle of the night and a 50mph temporary limit was in force. The notification says they were doing 59mph and must identify themselves or face further legal action.
Understandably this is a bit scary for someone who's never been challenged like this before.
Any tips?

The motorway, the time and the emptiness of the road are all irrelevant in the eyes of the law. If it's the first time, the speeder has been challenged like this, then he/she won't have any existing points. So write back saying who was driving, and then you'll likely get given 3 points and a modest fine, or an offer of a speed awareness course. Which is worse is a matter of personal preference.
Everyone knows that the M25 is rammed full of cameras and there are plenty of warning signs. If you choose to exceed the clearly marked speed limit, then don't be surprised when you are punished.
Just be thankful that the punishment is so lenient here. In Switzerland you'd be calling your bank manager about now.

Surely it depends on what is meant by temporary?
Do you mean that there was a temporary change to the mandatory limit to 50 (ie. there were some roadwork / managed motorway 50 signs) or it was a genuine temp speed with a 50 on the light up signs?
The latter, I believe, doesn't incur points but can be fines.
The former, banged to rights sadly.

I don't know, unfortunately. But I recalled hearing many years ago that temporary speed limits were different in some way to normal speed limits - I think it was that it was only an issue if there was an incident afterwards or if you were speeding in heavy traffic.Do you mean that there was a temporary change to the mandatory limit to 50 (ie. there were some roadwork / managed motorway 50 signs) or it was a genuine temp speed with a 50 on the light up signs?

I heard about the M25 temp speed cameras and that they were automatically generating penalties, and also that it was a police decision whether to issue the penalty or not. Obviously, the person in question hadnt heard this.

They must identify the driver and when the offer of a course/3 points arrives the driver must decide if they were speeding or want to fight it.
How is that scary?
Big fonts and an authoritarian tone from a police force can be intimidating to some people. How is that scary?
I've heard vaguely about points, presumably it's better to take the course and keep a clean license. The fine will be whatever it is, I suppose.

Temporary or variable limits are enforceable.

You've been listening to too many people down the pub.I heard about the M25 temp speed cameras and that they were automatically generating penalties, and also that it was a police decision whether to issue the penalty or not. Obviously, the person in question hadnt heard this.
Who over received the NIP will need to reply nominating the driver at the time of the alleged offence within the allocated time period regardless if they think they were speeding or not.
Failure to do so or doing so but leaving any doubt who was driving (i.e don't reply with "i think it was Mr X) carries a harsher penalty.

Possibly. There must be aMillion of these issued off the m25 every day. I'm usually the only one braking at the temporary speed limits, which switch 60,40,50,etc every few hundred yards (it seems). I passed one that flicked from 60 to 40 just as I passed , surprised I didn't get a notification if it's all automated.tinpot said:

You get 10 seconds after its changed from one speed to anothertinpot said:

This, I must agree with. I know of one lady who has done a speed awareness and has 3 points who I very much doubt was driving or speeding but paid up rather than put up with all the aggro at home.I've heard vaguely about points, presumably it's better to take the course and keep a clean license.
