Letting agent putting in constant flow of Jeremy Kyle reject
Discussion
Utterly pissed off with this to the point of distraction. Why in the f
k cant the letting agent on behalf of the landlord put in someone normal??Is it really too much to ask??
We've had it all,loud music,dogs s
tting all over the garden, people physically abusing their partners, arguing all hours, washing machines on early hours(you've got to hear this thing!!)
It just goes on and on!!
Flat above has has been empty for a while, guess what we've had inflicted on us now?5 adult ex-traveller types and their three yapping dogs.
Our dog,a husky used to sit on her todd quite merrily chewing at a bone in her garden but now, these f
kers can't shut a bloody gate behind them, our dog has alread escaped.
Due to the gardens lay out fencing is impossible,we have to keep the dog in all day now and im pissed off.
Whatever happened to letting agents requesting references??They just dont care, this constant flow of f
kwits is impacting on our lives,we've been here for 13 years as we like the area.
Is there even any small avenue to sue the letting agents/landlord?I've half heartedly threatened some kind of action before but i've never known how best to go about it,or if indeed it's possible?i just want them to be forced in some way to be accountable for their actions and the stress they're causing!
I'll just jump in with the usual witty reply,move!;-)

Well, it is the easiest way for you to resolve the issue...The council will have a noise complaint process.

More often than not though the council simply can't be arsed. The council will have a noise complaint process.

We had the same trouble - a group of 4 or 5 men moved into the flat under us and they'd stay up all night shouting, partying, loud music, etc etc until 5am some mornings. Not good when you have to get up for work at 6am.
The Council weren't interested - they wanted a log of all instances of noise (which we had) and evidence (which we also had) and then told us it didn't constitute a nuisance.
b
ds.Good luck OP - I feel your pain.
We had to move to get away from it.

Looks like 1776 wasn't quite early enough.
OP, have you ever seen Modern Toss?
I've had bad neighbours before but never sued? What a great point though!Got right into my thinking there!Looks like 1776 wasn't quite early enough.

It's the sheer persistent flow of utter f
kwits this particular Estate agent inflicts on us,why in the hell should they get away with causing us so much misery??am i missing something here? My misses is really having a hard time over this, she's just so quiet and never bothers anyone! But,now that she knows i'm finally getting a chance to sue someone,a lifelong ambition of mine seeminy then she'll no doubt be happier!I think im trying to get advice here from the very people that are pissing me off, coming back at me about having one dog in a flat, wtf? What about the three dogs in the flat above me?Oh yeah, missed that litle fact did we?
as if letting agents actually care - there areonly three things letting agents care about
1. making as much profit as possible from at littlework as concievable
2. where their s
t suits and brown pointy shoes are coming from
3. where to get the most ridiculous and over priced 'coffee' ...

Honestly, the easiest thing would be to move to a nicer/quieter area - perhaps one where you could afford a house.
Living in a flat (as I do - pressures of Central London) means that you're always at the mercy of your neighbours, over whom you have little control. I get on great with my neighbours, but that doesn't mean that they don't annoy me off from time-to-time (inability to put things in bins properly, letting fire doors slam late at night etc.).
Were I in your position, and I could see no end to the torrent of human detritus, I'd be out in a heartbeat. Do you own or rent?

Been there I'm afraid
. Heroin addicts above us. Problems were: Blood stained dressings left everywhere, needles, smashed glass, loud music, shouting, she used to beat the crap out of the bloke every night, banging (doors and noisy sex). At one time we could not go out the front door due to all the blood and glass.
They were only there for about 6 months but we could not handle it any longer so moved. It got so bad at 3am we called the police but the cheeky b
ds saw them coming and turned everything off until they left.
Make notes of EVERYTHING including times and dates. Also try video/audio footage as well.
But I will say that YOU will be the one moving.

I know your pain. However with some time and effort you can get this sorted.
For almost 1 year there was a complete horror living next door to me. Music full blast (some of it bloody awful, no one wants to hear Bryan Adams at 3am) and bellowing all day and all night. Yelling at the dog whom had serious separation issues when she went out.
It took a daily log, weekly complaints to the letting agents, keeping a log and citing areas of the contract that they were failing on. Then followed up by a complaint to the ombudsman. She eventually moved out (2 police visits probably pushed this and I felt no shame in calling them). At times I was called a liar by the agent "oh she wouldn't do that...." I did not hold my temper that time!
I know how it takes a toll on your health, your home should be a place of comfort but at times for me I didn't want to go home, I would feel sick when I heard the pounding coming from her flat, there was no reasoning with her and I tried many many times.
Be persistent, talk to them nicely, do it repeatedly, if no improvement then complain, a lot! If you don't get what you believe is fair treatment from the agent then escalate it. Most contracts have a clause about nuisance. I was lucky as mine stated "no nusance to neighbours, at any time" so my complaints covered not just between 11 and 7 but for all times. Still it took around 9/10 months to win.
Just to give you an idea of the noise this specimen of human form could produce with her gob and her stereo, my new neighbor fell down the stairs broke her femur, yelled and pounded on the wall for help and an ambulance broke the door in. I never heard a thing.

I suspect the landlord doesn't have a 'no housing benefits' clause in his contract with the letting agent, or may be renting to the council to put in those whom the council want to house. Sadly, particularly in the latter case, that's pretty much the type of tenant to expect - i.e. the 'problems'.

With local Council Authorities starting to implement Section 90 of the Housing Act 2004, the same that covers landlords, agents etc. having to apply for a property licence, where only a deemed responsible person/s will obtain a licence, that licence in part covering the control, reporting of anti social behaviour of a tenant/s.In both the OP's case, and the above two examples, it is now even more important that landlords carry out their own reference checks of potential tenants.
The OP should take up any anti social behaviour from nearby rental properties, with the OP's local council's environmental health office, quoting the above section of the Housing Act 2004.
