Hi,

I parked in a train station car park and payed by Phone. As the pay and display machine was broken.

Upon returning to my car I had been given a fine.

So I questioned it and got a response saying I had given the wrong car park code.

I don't dispute this, but have no way of checking. However the car park is run by the same company and I had paid enough to cover the parking charges for the car park I was in.

I responded by email saying I had paid, although had input the wrong code and considered that as I had paid that they had suffered no material loss and I would not be paying the fine. I received no response.

I then received a letter about the fine. A wrote in response as above. Again, no response.

I have now received a letter from a debt collectors. Obviously the fine is now larger.

Have I got any chance now of this fine being cancelled> if so what should be my next course of action?

Thanks

Ignore and let them sue. The fact that you've had no response to reasonable questions will go in your favour.

I expect it should also go in your favour that they have not suffered any loss, and that you made an effort to pay.

Did you do it by phone? I've had times where phone reception wasn't great and I couldn't hear the computer reading back the car park code and other things correctly to verify.

The cheek of it to threaten you with debt collectors. They often are disguising letters from one of their own departments as if to be one from a legit debt collector too. But as you have attempted to pay the standard parking charge I think it shouldn't go any further because you haven't really done anything wrong and I doubt they'd take it to court. Absolute cheek of it.

How many times have you, 1) gone to a machine - No change given! - Theft in my eyes, yet no one complains. 2) Paid for 3 hours and come back before 2, No rebate claimed from them! If you paid for another location, will they not agree to a rebate from the place you had paid for but were never in? NO! yet now they want to charge you for however much over the normal price when they've lost nothing. What losses are they expecting to recover? It make you mad!! mad

Maybe the parking fees are different at different car parks?

The fees I paid were more than fees for the car park I was in.

Not by me. Had a look and couldn't find anything.

It's probably been asked loads of times.

Looks like the same company to me.

OP, a train station car park may well be railway land governed by Byelaw 14. If so, it is not relevant land and PoFA 2012 doesn't apply.
There is also a lack of other relevant information which means it is impossible to give any meaningful advice.
This forum is not the place to find it anyway. You need pepipoo where this issue will have come up before.
