Hello,
Hope Insurance bods can advise. On 5th. August waiting behind car to pull out of hospital (right turn both our cars indicating right) main road busy so after a delay car in front starts to reverse, despite my beeping he reverses into my car. (him chrysler touring, me Caterham) damaged my carbon fibre nose, his damage hard to asses as rear covered in other obvious previous dings. He appologises 'didn't see me' I go into hospital reception to get pen & paper to take details (also ask does their security camera cover that part of road, no it doesn't, informed he is a doctor visiting the hospital) swap details with other driver, get estimate, inform insurance broker, what could be simpler.

Claims management company inform me they will deal, normal 'were you injured' BS. state no I was not just persue my car damage claim please.

when chasing up claims management, told not ins. with M & S. he told me but Tesco & they had not replied, later contact told tesco ins was on the car not him, but he was ins on multi policy with M & S. but they refused to deal with 3rd. party companies, & still the Doctor was not replying to any requests to clarify situation.

23rd. sept. I contact claim management again they state as they were not getting anywhere if no reply from anyone they would have to treat as driver uninsured & pass to MIB. to investigate today receive bloody great form to fill in for MIB. & covering letter which includes not liable to pay the first £300 of claim if you have insurance to cover this matter likely to be resolved quicker by own insurer.

I am extremely fkED Off that what should be simple is so fkING difficult. I do not wish to pay excess on my policy then hope someone gets off their arse to resolve in my favour some time in the future.

I do not think contacting the Doctor myself would be a good idea, as I have no powers to enforce anything,& what positive outcome from a Doctor who is a lazy, or disorganised, or deceitful . My fully comprehensive ins. should be working for me in a timely fashion not me in an amatuer stressful bumble.

Contact doctor - inform him that no insurance company seems to be accepting responsibility for him driving. He has 3 days to provide details or police complaint and complaint to GMC and hospital trust.

Thanks for reply just to be clear do you mean for him to contact his insurer / broker, and/or supply me with his ins policy number.
I already have his name & address & phone no., which I supplied to my broker.

I know you probably don't want to, but why not just refer this to your own insurer. Explain the position. They'll be able to check the MID database and find out whether he is insured and if so, who with. They will then pursue it for you, arrange to have your car repaired etc.

This is not an MIB claim - they won't deal with any damage to your vehicle if you're comprehensively insured and will just tell you to go to your insurer anyway. Odds are the doctor has insurance anyway.

That's what your insurance is for - let them do the chasing.

Thanks for reply nez. Yes originally reported to broker as per policy instruction, they put claims management co. on to it as per policy details. Do you think poss. management numpty doesn't know or not properly trained how to overcome hurdles.

Presumably you have a mobile phone number for this bod. Text him saying that if he doesn't get back to you TODAY with an explanation as to why he hasn't notified/instructed his insurers you will assume he is not insured and notify the police. Add the bit about the Trust and GMC too if you like.. Further say if you choose to ignore I will institute a small claims action against you without further notice.

If no response you know the type you are dealing with and you will need to pursue through the courts, escalate to High Court and their bailiffs for enforcement

So you have a claims management company, provided by your insurance company, who can't manage the claim ?

I would go back to your insurer, point out that you pay them for this "service" - you have supplied the correct details and what are they going to do about it ?

In the end it is their loss.

BTW - I would also be ringing the Doctor with a few choice words. (Though just check he isn't likely to be your proctologist in the future ...)

Thanks for replies so far I have just EMailed this to my claims management company to find out what response I get. I am worried about contacting DR. straight away in case 'professional' try's to claim I harassed him even though I would not it could provide a good swerve to delay further, but if no satisfactory answer from my claims co. I would have no other option I suppose.

COPY &PASTE OF EMAIL.

(After req. info what happening few days ago some one from your company contacted me, stated no contact from other driver dispute over who insured with & drivers ins. refusing to deal with you.

I stated something had to proceed surely claim could not be fobbed off in this fashion, your advisor said next step would be to treat as not ins. & refer to MIB.. I said please you must do something.

Today received MIB form to complete, I cannot see this as a solution MIB will only state he is insured & refer back after a long delay investigating, this could drag on for years which I do not find acceptable.

Please can a senior claims manager contact me to ensure this will be dealt with as promptly as possible, surely you must be able to legally compel a professional company to deal with matters, now I believe it has been established whom he is insured with, not for them to just refuse to deal with you another professional company.

Yours sincerely)

Seriously, AMC's are idiots. They're not lawyers and they're not from insurance companies. Just bypass them altogether and report to your insurers and let them deal. Yes it may cost you your excess but you'll get this back from the doctor if your claim is successful.

st happens.

In future get insured with a proper company and let them deal with it. When someone ran into the back of wife's car I didn't have to pay the excess and recover, our insurer took care of it.

Or give up driving.

What is the issue?
- phone your insurance company
- hi, this happened
- please let me know details of where / when car needs to go to get repaired
- thank you

let them worry about the other person - not your issue...
Why do you need an accident management company to handle a 30 second phone call?
you pay your insurance premium so that your insurance company can pay money to you when your car is damaged...

move on...

He will of course claim that you hit the back of him.

I'd harass him and the hospital.

When I had similar I explained to the other insurer - I contacted them directly - that whilst I was only intending to claim for accident damage I could feel my neck starting to ache.

That seemed to speed them up !

I'm no great literary, but a little more literate than some on here, not an 'innit bruv / text speaker' I scrape by as others who have posted advice seem to more than 'barely' understand me.

As much as the OP can't write, you haven't even made half an effort to read the issue at hand.

OP - I would be very careful. Do you have a hire car from the AMC? If so you are running the risk of a big bill if the Dr does end up not insured.

Clearly the AMC believe he isn't so are trying to wash their hands of it ASAP.

Go back to your own insurer.
Explain that the AMC are idiots and that you are hearing that M&S (who are the Drs insurer to the best of your knowledge) are refusing to deal with AMC so AMC have referred you to MIB despite you having been hit by an INSURED MOTORIST.

Just refuse to get off the phone until someone responsible starts handling your claim.

Thanks for helpful replies, just to confirm not great damage in great scheme of things so no hire car needed (damaged carbon fibre nose cone off, new nose on. Carbon fibre more expensive than plastic but much cheaper labour etc. than a normal car nose damage)

Standard procedure seems to be nowadays report accident to broker who then delegate from there, acc. man. co. state to save paying excess & recovering they get everything agreed first, so repair done no excess to pay, seemed logical to me saves my cash flow.

No experience of going against Insurance procedure stated in their terms & conditions and insisting on Ins. dealing direct I presume if you tried to get them to work differently to their standard practice they would just refuse.

Thought I was with decent Ins. co. / Broker been with them for years seemed ok in the past, will have to reconsider options come renewal time obviously.

So on this occasion things not smooth as expected will have to make more effort to try & resolve than I anticipated. I agree full comp. ins. their job to chase not mine that's why I choose that kind of policy, but will have to chase someone, whether Ins. / broker / acc. claims co. / other driver or combination.

I'm now presuming because acc. co. unable to make much profit as no injury or hire car claim, uninterested and on back burner of things to do.

As for improving my literacy or communication skills I'm going to let that one slide as I normally get by in life.
So if my ramblings are too difficult to understand feel free to Ignore if you wish (like no wot eye meen innit yeh respek)

Will keep thread updated
