I purchased a Cat Back SS exhaust system last November.

Car was barely used over winter.

I noticed horrible noise around April which i thought was the gearbox, so replaced the gearbox and noise was still there! (can't blame them for my incompetence here!)

Traced it to be a loose baffle inside the central silencer, of my brand new exhaust!

Contacted seller, who asked me to send the whole exhaust back at my expense for checking, they then sent me a whole brand new system in July.

Now into September The noise has come back and is getting louder.

The car has only done around a 1000 miles throughout the whole year.

Im getting fed up at fitting exhausts, and its not exactly cheap to send them back! Also the 1 year guarantee will end in November.

So how many more replacements do i need to accept before i can ask for a refund?

Yes it was relatively cheap at £260, but id expect them to last more than a few hundred miles!

First point is that the return should be at their expense if the goods are faulty.
Second, I would say that three with the same fault is more than sufficient to ask for a full refund including all the postage costs. 'Not fit for purpose' comes to mind.

Well was looking promising, they asked me to send them a video to show that the silencer was faulty.
And they will likely issue a refund, as they are out of stock.

Sent them these video's:

They have now stopped replying.

Was paid with a credit card (amex) through paypal.

As its too late to claim with paypal, can i go through Amex and try a section 75 claim?

And should i be successful?

Cheers

frown Using your credit card via Paypal means losing your Setion 75 protection.
A great many people are unaware of or don't understand why this is the case.

With Paypal you are not dealing direct with the seller. See:
http://www.moneysavingexpert.com/credit-cards/PayP...
And Section 3.4 of the Paypal User Agreement.
https://www.paypal.com/uk/webapps/mpp/ua/useragree...

See Section 13 for Buyer Protection and supplier disputes.

None. See below.

If I have understood correctly you have now had 2 exhausts from the same source with an identical problem.
That suggests a faulty batch and a third one won't solve it.

However you must also consider that they are fakes. Japspeed's price for a S2000 cat back system is £349.
Plus they are currently out of stock. A 25% discount on the genuine article is too good to be true imo.
