Which mobile user more at fault?

Just before 5pm yesterday, heavy traffic. I clearly observe driver in front of me using phone (held to ear to talk FFS, 65 plate vehicle that undoubtedly has Bluetooth hands free as standard) as we turn on to street in image.

Student stood on double white lines in middle of road at top of bridge, between traffic moving both ways, staring at phone in hand.

Driver in front misjudged her position relative to student, clips her with wing mirror, bumping her (luckily) in to side of just become stationary van that a second before had been moving in other direction.

Personally I'd like to see both of them sent to the gallows for behaviour, but whose offence is more careless? Keep in mind that on the other side of the bridge, less than 30 yards from where incident happened, is a pelican crossing.

I'd say they're as bad as each other-

1) Driver - piloting over a tonne of metal that could injure someone else, should have taken more care

2) Pedestrian - in a terribly vulnerable place and not protected by a tonne of metal, should have taken more care.

Someone got out of bed on the wrong side, didn't they? As for individuals who cannot distinguish between your and you're, a special punishment should exist for them...

Pedestrians always get "right of way" no matter how stupid they are being unfortunately.

The car driver is doing something illegal, the pedestrian is just an idiot.

Round these parts, when the old people aren't pulling out on you, the next biggest hazards are:

• Yoofs with banging tunes on their headphones crossing roads without looking
• Mothers who think that a good way to get traffic to stop is to push their baby in a pushchair slightly into the road.... you wouldn't mow down a baby would you

I wouldn't send them all to the gallows though. Taser to the genitals for each offence should suffice

Too many fking idiots wasting oxygen these days, we could do with losing a few. Funny as i don't have any race/sex/religion issues but i really fking hate stupid people. And by that I don't mean those that don't know you should never really start a sentence with the word 'and' but those that make you wonder how they manage to walk, talk and breath, all at the same time...
