Section 59 for excessive speed
Discussion
Hi,
Situation: Got pulled over doing an average of 112 mph on a motorway. Undercover bobbys pulled me over and basically said "please step out so we can talk about losing your license". I was cautioned and it was made clear I was going to get a ban for something like 6-9 months, or could go to court and they could decide to even slap me with a prison sentence for dangerous driving. I didn't get breathalysed. I was polite, called them officer, listened carefully, explained I had a clean licence, then they checked my tread, checked my tyre pressure and I explained I just pumped them that morning etc. He asked if I rely on my car for work, I said no but instead I'm a masters student at uni halfway across the country and the reason I had been speeding was because of an argument I had with my girlfriend and wasn't focused on my speed as much as I would normally be. I realise this isn't an excuse, just the truth of the situation. Then after all of that, he spoke to his colleague and came back to me saying we could go down another route and give me a Section 59 warning. Hopefully that is enough detail.
I was explained it was similar to probation and normally it's for people who go over red lights, handbrake turn, wheel spin and drive off road. It was also explained it was like an ASBO for driving. Finally, if I reoffended or got caught speeding or anything in a year, my car would be taken off me and I'd have to pay a "huge fine" for it to be given back to me.
My questions are:
1) What exactly is a Section 59 - I was doing 112 (average) in a 70. They were clear to class this as dangerous, not careless, driving. I can read wikipedia, I don't need someone copying that, just explaining how a section 59 relates to dangerous driving please
2) How much would the recovery fine be if I reoffended / sped again in a year etc
3) What can cause me to get screwed in the next year? (apart from speeding)
Any other comments on what people know about Section 59's *in relation to* dangerous driving / extreme speeding
Yes I shouldn't have been speeding, I would really appreciate if the thread can stick to the questions I'm after please
Cheers

You were very lucky if you just get a section 59. They are mainly used to deter boy races and people generally pratting around with their car.
Just drive normally and you'll be fine. I might be wrong but you may still be able to get minor speeding tickets without it affecting your section 59.

You were very lucky,
Basically, if you decide to go down Halfords car park, and try and pull donuts in your FWD Clio, you'll be in trouble,
A s.59 is more for ASB, wheel spins, HB turns etc.
If you got caught doing any of the above, your car could be taken off you immediately. Worthy of note, is that the S.59 follows you AND your car around. So if your mate was to jump into your car and pull a donut, your car could still be taken. And vice versa. Recovery costs are ~£150.
Can't recall how long S.59 stay on the system for. As long as you drive tidy, you should be fine.

That could come back to bite you on the arse in court if the cops noted it. Basically says you were doing in excess of 112mph in rage and questions whether you were in a fit mental state to be driving at all as you clearly weren't concentrating at all to end up 42mph+ over the motorway/dc speed limit. "Just out for a blast" would've arguably been a better answer.Situation: Got pulled over doing an average of 112 mph on a motorway. It relates to careless driving or prohibited off road driving where causing, or is likely to cause, alarm, distress or annoyance to members of the public.1) What exactly is a Section 59 - I was doing 112 (average) in a 70. If you are driving dangerously then that will satisfy careless driving.
The courts burden of proof for evidence isn't required for the officers to act & issue a Sec 59 warning.

There isn't a fine. You pay the vehicle recovery costs & storage costs, so the longer it's at the pound the more you pay.

As far as Sec 59 you driving your car or another car (or somebody else driving your car) in a careless or prohibited off road manner where it is causing, or is likely to cause, alarm, distress or annoyance to members of the public.Careless driving merely being your driving falling below the standard expected of a competent & careful driver.

As you've surmised - it's a formal warning. An alternative to prosecution... for the moment.jay44 said:
2) How much would the recovery fine be if I reoffended / sped again in a year etc
Quick google suggests the fees are £150 + £20/day for the seizure and storage, with another £75 for disposal of the vehicle if not paid and claimed within 21 days. Prosecution for the original offence plus prosecution for whatever you get a tug for next time. This one's not going to be a fixed penalty. It's going to be a day in court.jay44 said:

Almost anything that causes a pissed-off man in a uniform to check your plate, find the s59 tag, and realise that you can't take a hint.jay44 said:

A summons for an offence isn't required in addition for a Sec 59 warning to be issued.http://www.pistonheads.com/gassing/topic.asp?h=0&a...

You can have summons & Sec 59, Sec 59 only or summons only where sufficient evidence exists.
It's midday on Rememberance Sunday in a well-heeled part of Cheshire, 2 Lambos and a Merc SLR cruise through the Main Street crowded with people waiting for the parade to pass. They reach the top of the street and then open-up to full throttle before dropping their clutches.
S59 seems ideally suited to dealing with utter pratts.

@WonkeyDonkey - Yeah I realise how lucky I was, couldn't find any other example of this online. Think the bobbys just wanted to give me a break and could see I was being genuine (even still, lucky)
@mk3spitfire - Yeah I don't do that stuff anyway, thanks for saying it applies to both the car and me
@allthatjazz - I wanted to co-operate more than anything tbh. If it went to court (which it's not) they already have more than enough video evidence than they need. What I said isn't going to have that much bearing. It would be the same regardless of anything said
@vonhosen - I thought that careless and dangerous driving were two completely separate categories, which is why I was so surprised to get a Sec 59 for dangerous, rather than careless. Thanks for info about recovery, thought it was different to that
@toomany2cvs - thanks for final cost estimate
@chester draws - nah I asked about receiving correspondence in the post, he said I wouldn't be getting any. Just my details on copper computers for a year about the sec 59
Just a couple more questions...
Would a speeding ticket / 2nd pullover by bobbys count as having my car taken away? (not handbrake turning / wheel spinning etc - just regular speeding)
If I get pulled over for whatever reason in the future and they ask "am I known to police" - would I now have to answer yes, in reference to the sec 59?

Careless is below the standard.Dangerous is WELL below the standard.
Speed way in excess of the limit is routinely dealt with as Dangerous in Scotland - were you in Scotland? If you weren't, then I suspect that there were other circumstances, not just velocity, to make them start to slap you with the DD stick.
Honestly, can you put your hand on your heart and say your driving was just fine in all ways except that number on the speedo...?

Ergo if you satisfied falling far below the standard expected with the dangerous you'd have fallen below the standard expected for careless.
Just as where you enter as a trespasser & steal (burglary) that doesn't mean you haven't committed a lesser offence (theft) as well, you're just not going to get charged with both.

You clearly don't know if you are known to Police or you wouldn't be asking, so that's your answer, 'Not to my knowledge'.Wait until you sell the car or buy a private plate to drive enthusiastically again. No idea how long the S59 marker lasts for. Sounds like you've lucked out there to be honest.
If I were cynical they probably knew they didn't have the evidence to do you for the speeding, but decided to f

Just a couple more questions...
Would a speeding ticket / 2nd pullover by bobbys count as having my car taken away? (not handbrake turning / wheel spinning etc - just regular speeding)
Where it's considered your driving fell below the standard expected of a competent & careful driver etc etc as per a Sec 59.Would a speeding ticket / 2nd pullover by bobbys count as having my car taken away? (not handbrake turning / wheel spinning etc - just regular speeding)
Yes.

If I get pulled over for whatever reason in the future and they ask "am I known to police" - would I now have to answer yes, in reference to the sec 59?
You clearly don't know if you are known to Police or you wouldn't be asking, so that's your answer, 'Not to my knowledge'.He hasn't said he is selling the car.
