So one of these ''Demands'' have come through the letter box this morning. pay £60.00 now or £100 later..

But i was parked there with no ticket as my car is a Motability car with a blue badge. There was no bays to park so i parked in a normal space and displayed my badge. Ive never paid in this car park before and always parked in a disabled bay.

They don't give this as a reason to appeal and won't listen to this on the phone. Ive not not spoken to M&S yet but i am considering this.

Or do i give this demand to my daughter to practice her writing on? Or follow the appeal process

Regards

Al

You do not have automatic right to park free of charge in an off-street carpark. See section two.

https://www.gov.uk/government/uploads/system/uploa...

Your best bet is probably an appeal to M&S.

Doc

DONT contact the ticket issuer

DO register with pepipoo.com and give them chapter and verse

LISTEN to what they say

DO exactly and i mean EXACTLY what they tell you to do

BUT DO NOT contact the ticket issuer and finally

DO NOT tell them ( the issuer ) who was driving

Your right but on the large notice it states that blue badge holders are exempt from parking charges with a blue badge on display.

But does it say in disabled bays only (in very tiny writing) ?

You should definitely do so. Approach the M&S store management directly and ask if they are happy for a disabled customer of theirs to be treated in this way. If you get no joy locally kick up a fuss here.

This too. However the bit below is concerning as it suggests he may have already unwittingly shot himself in the foot.

Unfortunately this is a mistake that far too many people make because they lack knowledge of the 'rules of the game' and how it should be done.

This may be the OP's Achilles Heel. A photo of the actual sign in question is essential. It could be site specific rather than Smart Parking's usual generic offering.

Btw, OP, was this a windscreen ticket or picked up via ANPR?

ANPR arriving and leaving, I need to collect a new suit tomorrow so will be speaking to the manager to gauge his reactions. I'll also check the sign too see and get a picture too.

I don't get how this would work if blue badge holders can park free.

I'm not sure either.

The ANPR car parks round here on a major supermarket, you show your blue badge at the customer service and they give you a free ticket (with code) for the payment machine. I'm also not sure how come the OP got a ticket as I would have thought the only checks done on an ANPR site would be to see who was parking in a disabled place witheout a blue badge.

Given the OP parked in a normal bay I suspect the PCN has been issued for non payment. If ANPR is by an entry/exit camera it begs the question of how free parking for Blue Badge holders is monitored. The signage could be crucial here. I hope any photos the OP takes will be clear enough to read the full t&cs.

I've been told of some ANPR sites where you still have to get a ticket on entry - where you have to enter your reg number as well and still display the ticket (for manual checking) . If Disabled are free I would assume this isn't necessary - providing the Blue Badge is on display.

Quite common. This is the sign at one of SP's most notorious sites: Fistral Beach in Newquay (they took over when the even worse PE were kicked out).

VRM required and in this case Blue Badge holders don't get any freebies either which is also not at all unusual on private land. frown

I wouldn't assume anything where a PPC is involved! rolleyes
I'm not sure how an ANPR camera will pick up a Blue Badge while parked f.o.c.
Its whole purpose is to record the VRM when entering/exiting.
Hence the acronym: it will be focused on the plate.

Just for scensoreds and giggles (and before anyone chips in, I appreciate it's not the norm) read this.
