A bit of advice re a Moneyclaim
Discussion
Hi all, just after a little bit of advice.
I'm a business that buys a lot of parts from a car dealership (parts that aren't available elsewhere).
Last June the ownership of the dealership changed hands. During that time accounts were suspended and I was making payment by debit card upon delivery.
During this month a part was returned and a credit issued.
I never received a credit note but I have been given a document number. There has thus far been no dispute, but they just won't pay me. All attempts since last June have got nowhere and I've had enough.
Now, who do I issue the Moneyclaim against? Do I use the address of the dealership who supplied the part, who say this has to be dealt with by their head office (at another address)
Or do I issue it against the head office, the address of which is on the sales document relating to the part?
I'm just trying to avoid having to issue the Moneyclaim more than once.
Many thanks for any assistance.

Thanks, but the ownership of the dealership has changed, so I'm now effectively dealing with a different company. My claim is against the dealership's previous owners.
Is it?Is the dealership run by the same limited company, just with different owners?
Or is it now a different limited company? If it is, then do you know for sure that all liabilities were not transferred as part of the sale?

Well, as a customer I don't know about the transfer of liabilities, I guess that's a risk for my £25. I do know who I bought my part from though, they still exist as a (limited) company, they just don't own the dealership anymore. It's their address that's on my sales document. Is the dealership run by the same limited company, just with different owners?
