Speeding - PLEASE HELP
Discussion
Hi,
I am into my first 6 months of driving.
Yesterday on the M62 to Pontefract i saw an average speed camera flash me.
I was doing around 80mph in either a 50 or 60 average speed check (not sure, was the one with the black camera).
In your first two years you can only get 6 points and your license is taken away.
Will i get 3 or 6 points?
Of course the 14 day wait until the paper work is far too long to find out. It is killing me. eeek.

I thought average speed cameras fed the data to a CPU which then decides if you're speeding or not and issues a ticket automatically? And the cameras don't actually flash?
Either way, you're a pretty new driver. And that's a pretty stupid speed in a 50 or a 60. If it's a 50, surely that's game over.

i believe points for speeding on a motorway starts at 6 with no option for 3 at all ... therefore at best your losing your license and having to resit
At worst being potentially 150% of the limit could end up with a worse penalty (assuming it was a 50 zone)

80/60 is a fixed penalty. 3 points. £100.
80/50 is a court hearing. The Yorkshire courts guideline for 80/50 is a 14 day ban. If that happens then your licence isn't revoked. If alternatively the court orders endorsement of 6 points then the DVLA will revoke your licence. If you get a SJPN then you should insist on a court hearing - do not attempt to deal with this case by post if you seek a short ban rather than points.
To save me typing it out each time, there's bit of an explanation here: http://www.counsel.direct/news/2015/3/25/speeding-...
Ignore the lunatic who "believes" motorway offences carry 6 points. Sadly, some mumsnet types will be along shortly to tell you that you're a dangerous driver or something. Ignore them.

Take better care to follow the rules of the road while on your first 2 years; unless you like resitting your test. Regardless of the fact you've passed the driving test, remember that you are still learning.
Always comply with speed limits through roadworks; they're notorious for having speed cameras.

Sorry but what makes you think the OP doesn't have valid insurance? Yes the other thread throws up the question of whether OP has declared his mods or not but he never said he hasn't. The closest he said is: "I must admit it wasn't cheap to declare the mods!"So he knows he has to declare mods and knows how much it cost to do so, whether he did or not none of us know. What makes you so sure therefore that 'the OP also seems to be driving a car without valid insurance'?
OP, it won't be a nice 14 day wait but for your sake I hope nothing comes through, and that you learn from the experience. Keep us posted!
The OP doesn't seem to understand how average speed checks work.
First of all they don't 'flash'. They are just camera clocks which record the time, not cameras which record the speed. So if he was flashed it wasn't an average speed timing camera.
If it didn't actually 'flash' then it could be an average speed camera clock, but it is the average speed between any 2 camera-clocks which matters. In fact, you could pass either or both of the camera-clocks at any speed so long as the AVERAGE speed between the two is not in excess of the posted limit.

He may be referring to the new cameras which often appear on these Smart Motorways & i for one have yet to work out how they work, what triggers them & if they flash. Normally sat on the upright of the gantries that also house SPECS or Gatso & could be why the OP is saying it's an average speed camera. Do these flash as they look as though they might.
Either way, if the OP saw a camera flash behind him & he was doing 70-80 in a 50 then it could just be a Gatso or any other forward facing camera, but it could have been sighted in roadworks that also have Average Speed cameras, hence the confusion.
Hopefully lesson learnt that ignoring a temporary speed limit on the motorway by such a margin is bound to end badly & if you were doing 80+ then expect a court summons & likely ban given the time you've had your license as the Magistrate will surely not go lightly on you. If only doing 70 or less than i'd guess you'll be facing 3 points & a £100 fine.

"Around 80"???
How accurate is speedo?
Is there a tolerance/allowance on these section as 10% at 80 = real 72mph.
Not condoning stupidity of new driver doing this speed through roadworks though.
Good luck Pal - learn from this...

The last 3 cars I've had, all being newer than 61 plates, when using GPS to check my real speed, it has always been within 1mph of my speedo; from 30 to 70.
Average speed cameras don't flash but they do appear to give off a red glow when registering the numbers, it could be that he is referring to?
Your approach will depend upon the speed registered but if the top end then you could face 6 pts as AGT says, The court will not then "Ban" you but simply add 6 points to your licence, it's then down to DVLA to revoke your licence and you will face an extended re-test.
Only other option best faced with a lawyer (again as AGT said) is to argue for a short ban rather than the points which will prevent revocation. With a good argument it does work but is not always successful.
