Looking for some advice for one of my colleagues which has had the following problem to deal with recently.... Below is a post he put on Facebook:

My wife and 2 year old son were literally pushed off the M1 motorway, at speed, by a Foreign truck driver on 1st March. The truck driver didn't bother to stop leaving my wife and son very shaken up and the car in a mess.

Despite there being CCTV footage of the whole incident which clearly shows the haulage firm in question, Bedfordshire and Hertfordshire police have sent a letter to us today saying that there is absolutely nothing they can do.

Not only does this mean that our insurance company has no-one to claim from (thus our premiums are going to go sky high for years to come) but what's more worrying is that this letter effectively suggests that Foreign drivers can actually get away with doing anything they please on our roads so long as they don't stop at the scene.

Anyone got any good ideas on ways to get this pushed further? The next person this happens to could be seriously hurt or even killed and suspect the police will respond to the victims families with a similar letter.

Any of you had similar experiences? Advice welcomed... Cheers.

No help, but I really don't understand why the police are not being active in this.

I would contact the Daily Mail and my MP and start agitating.

It does seem rather odd. Too much like hard work I guess...?! I believe it was a Hungarian lorry from a big name haulier over there, so I am pretty sure they could be found... As he says, not taking these sort of things seriously sets a very bad precedent...

Just give the CCTV to your insurers and they'll sort it out. The police don't need to be involved to get this sorted.

Good point, however, how can one be sure that the insurance company will do as all they can to help the OP keep his premium down on the next renewal?

Big yellow tractor unit? Will be Waberer's if so, 99.9%. They have the worst reputation in Europe for crashes and employing the most unskilled drivers they can find.

Hit and run - Yes they do surely! Public shouldn't have to put up with cretins on the road just 'cos it's easier to do nothing.

First off I think they'll want to get the cost of fixing the OP's car back. Secondly, the OP can go to whichever insurer he wants next year, so it doesn't matter what they do to his premium.

Send a copy of the letter to his MP and ask them to deal with it.

And that's why the police are doing nothing - because there's nothing they CAN do.

No plate, no driver ID. It's just a truck with a particular-logo trailer on it, belonging to a large haulier. Nothing to do with nationality.

Log of driver/truck movement is surely a vital requirement?

Is it one of their drivers/trucks towing the trailer though or sub'd?
You've got to be able to identify what truck it is to hunt the driver.
It's not a legal requirement for the operator to know where their trucks/trailers are on the network at all times.

Playing devils advocate here but was the lorry aware he had caused an accident?

A collegue was side swiped by an overtaking lorry in 50mph average works and pushed him in to the cones. (Luckily just after the concrete barrier).

He chased down the lorry and got him to pull over and said he never realised.

Having never driven an HGV I can't confurm but am not suprised he didnt feel anything given their sheer size and weight.

The one in the same place and at the same time as the OP describes.

I'm no expert, but some quick thoughts of what I'd try next.

1) Speak to haulage company directly. And put everything politely in writing. Seek their assistance investigating the matter in the friendliest way you know how. See if they are even aware of the incident. They might be willing to help investigate, provide tachos/logs. If they brick-wall you, warn them that you will have to:
2) Speak to a solicitor about a civil claim against the haulage company using the CCTV footage as evidence.
3) Go to the tabloids. "The killers on our roads, and the police who let them away with it" etc etc. OK, I probably wouldn't do this, but I'd sure think about it in the shower and imagine a very successful outcome and feel good about it.
