I'm still seeing lots of people using phones while driving, mainly builders vans for some reason.

However yesterday I spotted a passenger holding the phone up to the ear of the driver, I assume the driver gets away with it. but is there a law about passengers distracting drivers, if there is I'm reporting my kids for always kicking the back of my seat.

The law says the driver mustn't be holding a phone...

Don't forget "Not in proper control of vehicle" - A lot easier to prove if someone is swerving about whilst fiddling with sat nav or something.
