Yup. Deliberately proactive thread title. But a bit of a rant (sans swearing)

26 year old Lawyer hits a 91 year old ON a Zebra crossing. Weeps in court gets to walk free. Claims to have been doing 10mph

19 year old teacher kills a 77 year old on a Zebra crossing. Lies to Police saying she was blinded by the sun. Suspended sentence.


In both examples seemingly no attempts to brake, so we can guess where their eyesight and attention was...

Sadly inevitably they'll be thousands of other cases in recent memory, and probably a handful this week



WHEN will the courts stop doing this? Both these cases were on Zebra crossings, against Highway code. Surely that merits punishment. Even if just 3 months in prison to send a message (much like the case of that bike rider with no brakes who received 18months after he hit and sadly killed that woman recently)

Why do courts and the public at large seem to accept that driving haphazardly and not paying attention and hurting people can be explained away as an accident and you don't need to be punished? If you operated any other machine this badly and killed someone you'd be held accountable.

I truly believe that if we were harsher on driving crimes the general standard on the roads would improve dramatically. It's infuriating to me, even with no connection to either case, that there seems no appetite by the powers that be to address the 1700 odd fatalities every year on our roads. If you start punishing, surely that will drop by a decent chunk?

The first one - says no evidence of using a mobile phone. Sounds a bit dodgy, though.

Any excuse seems to be good enough when a motorist kills a pedestrian or cyclist. Slap on the wrist or a small fine and some points and off you go, continue driving as though your victim's life means nothing.

When a cyclist kills it's grounds for a jail sentence.

It's a joke and nothing ever changes.

It would be useful to abolish the word 'accident'

If I walk out of the shower and my towel snags on the door leaving me starkers then thats an accident

If I mow down a promising young footballer on a Zebra cos I want paying attention then somehow thats an accident too

Stepped from behind a tree and suddenly appeared in the middle of the road when she was doing 10mph?

I finding that hard to believe.

First case was charged with careless driving and cleared. Maybe wrong charge?

Second case pleaded guilty, showed suitable remorse. No idea of sentencing guidelines. Guess it will be deemed appropriate?

Do you have more info than the articles?

Well, as far as the first one is concerned, it appears that the court believed her when she said that she was going very slowly and that there was an obstruction to her view (a tree). I don't know whether that is true or not, but I wasn't there so I am not going to say it isn't.

A pedestrian crossing does not give a pedestrian the right to walk out without looking to see that any traffic is not too close to stop , so just because an accident occurs on a crossing does not mean that it has to be the fault of a driver.

In the past few days, I've had 2 near misses with pedestrians stepping out into the road. And the lady in Sainsbury car park walking into the side of a slowly reversing car. Of course, the fact they have their mobile phone stuffed in their ear hole at the time isn't relevant, is it ?

You don't mean "we", you mean "you". You are apparently happy to ignore evidence and the courts and punish based on your own prejudice?

Hopefully you are in a tiny minority.

Until we remove juries from the trials of motoring offences killers will continue to walk free - "there but for the grace of God go I" is simply too strong.

Which of course will never happen, so self-driving cars are the answer, as humans are so manifestly bad at paying attention to the degree required not to kill people on a daily basis.

The cyclist convicted made three errors

Failed to afford a good lawyer
Failed to play the system , show remorse etc
Failed to realise you Never shout at a pedestrian as they always flap about and you will hit them !!

If a pedestrian walks out , say nothing , asses their speed, pick a spot go round them.

Clearly you do not cycle round inner cities

I did, but I used front brakes, did not try to "race my pb".
