Hi all, could anyone help me out with a photo of the pay and display car park signage? I've just had a letter from some parking charge people referring to my 13 minute "park" there 2 months ago. I don't recall seeing any nasty notices but as i live in Essex it's a bit difficult to pop down at take a pic!

Would like to appeal as i was only waiting (rather than parked) while we assessed whether the beach was accessible for my disabled daughter (it wasn't).

Parking

Parking is some distance away. The pay and display car park operated by Torbay Coast & Countryside Trust.

OP i've not been down there for a while, however it used to be pay & display?

Tried that but looks like Google were too scared to go in there, and the car park seems to be owned by some trust who have obviously farmed out management.

Nope, we had only just popped in there to check it out for a few mins, so never properly parked up.

It was pay and display and i would have been happy to pay had we decided to stay. I'll pay the charge if necessary but a £50 'charge' seems a little harsh for driving into a car park and waiting a few minutes. I just don't recall seeing any big parking charge warning signs, i hadn't even bothered to wander over to the P&D machine to check how much and if disabled badge holders were free as we were only passing by.

I would appeal as the keeper. Always the keeper, don't identify the driver. Explain you were assessing the beach for your disabled family member. It would be a PR nightmare for them if they did not cancel it.

Looking for a parking space,assessing the suitability of the site(not just the beach,the actual car park as well), checking the costs & T&Cs, and then leaving, do not count as "parking". Write & say "the driver did" (Not "I did") this,and so was not parked. Ticket should get cancelled, but you may expect lots of toothless demands.

Respond saying the driver entered the car park acknowledged and considered the terms and conditions of the car park and rejected the contractual terms and left

I walked from Babbacombe to Shaldon last weekend.

You waited 13 mins? What did you do? Or was that waiting time to get into a space?

If that is the car park the OP was in, Park With Ease is an IPC member.
Their appeal process is a kangaroo court: he wont get anywhere.

See the IPC Code of Practice paragraph 15.1 re Grace Period on entry.
(The BPA equivalent - Section 13 is similar).
The key question is what is reasonable?

That said, the Contractual Agreement on the notice specifically says BY PARKING...
ANPR cannot prove any period of parking, only the duration on site which is not the same thing at all.
One for a judge to decide. As in the case of Dave Hotchin at Fistral Beach in Newquay. biggrin

if its pay on exit how did the OP get out?

It means you us ether touch screen, enter your reg plate and it tells you how much you owe. The anpr camera on exit recognises the vehicle leaving.

Thanks Alan, that's what i'm looking for smile Sadly no blue badge exemption and contract guff to read so i guess i need to rollover and pay up frown

Yes, got out wandered down the the beach which turned out to be a 5 min walk down a steep cliff path and steps.

I don't know if that was the very same car park but it's Park with Wease demanding charges and looks to be in the area.

Interestingly on the IPC code of practice 5.1(m) it states notice must be given 14 days after the 'parking'. Given that this letter is the first i've heard of the issue after 2 months maybe i have a little wiggle room?

yes they are outwith the 14 days for ANPR PCNs so you could also go back and say, sorry you are too late to hold the keeper liable under POFA 2012, take it up with the driver (who i will not be naming)
