So i got a speeding ticket last February, I paid it and submitted my licence in time.

last month I noticed there was £100 debited into my account from HM courts.

I phoned them and they explained it was for failure to supply documents which I did. I never noticed my license not being returned as I was away for 4 months.

I then received a letter demanding £600 and six points on my licence.

after receiving the letter from the court they have my D.O.B wrong, I've done a DVLA check and I have 0 points on my license.

should I pay and keep quiet that they have my details wrong or should I refuse and say it wasn't me?

Well, as your driving licence (license to many PH posters) has your DoB in the middles, it is difficult to see how you have not noticed it up to now, but hey ho. DVLA also has your address and other details, I don't think a DoB error will be an escape route.

It's not for you to point out their error, but pay the fine and inform your insurance of the points. I think the only time it might be worth playing on is if you ever tot up.

I am feeling helpful, and a bit bored today...
I assume this was a fixed penalty - in which case they must have been able to contact you, made you the offer which you thought you had accepted.

Something a bit odd here, but maybe due to auto correct.
Do you mean that the Court returned your payment? If so, I believe that is what happens when they don't recieve your licence for endorsement (seperate argument as to whether you sent it, or whether they lost it). As far as they are concerned, you haven't complied with the offer of the fixed penalty.

I note you have been away for four months - did you not make arrangements for your post to be handled/forwarded - or do you have a bundle of letters from the Court that you haven't opened?

Again a bit odd - 6 points for what would have been a fixed penalty offence?
It can't be a FtF as they sent you the original offer so they do know who you are.
Was the speed massive?

It seems you have already accepted the offence by paying the original fine.
Possibly no points on your licence YET as you haven't sent it in again (maybe because you no longer have it).
Is the DoB that is actually on your licence wrong, or is it the DoB on the letter from the Court?


I think what you should aim for is to do a Satutory Declaration that you had no knowledge of the conviction - then turn up in Court for the new hearing and ask for a penalty to be applied as per the original Fixed Penalty.

However, I think that will only work if it ISN'T your fault the paperwork went missing...
