I’ve had the unfortunate experience of receiving a NIP for the 2nd time!

I currently have 3 points on my licence and have been driving 15 years.

I have just received NIP for 95mph in a 70mph zone on the M62 from a gantry camera near Birstall Leeds. This offence took place at 3am on an empty motorway on my way to the airport.

I have looked online but haven’t been able to find any clear understanding of what my fine/points will be or if I will have to attend court or possible ban.

Can anyone shed any light on this as it’s playing on my mind?

Many thanks
Ross

Ah the joys of the M62 Smart Motorway - it's pathetic isn't it really, but anyway ...

You may get a 3 points/fine letter or a summons, but either way you can plead guilty by post. If it was me and it was the latter I would go to court, be polite, point out you were running late for the airport and it was 3am with an empty motorway.... but make sure you apologise and hope they give you 3 or 4 points and a fine. Good luck.

Up to 85mph in a 70mph limit is most likely an awareness course, depending on eligibility determined by past offences with that police force.

86-95mph is most likely an automatic 3pts and fine.

96mph or more and the judge gets to decide.

I am interested in what was going through your brain?

There are speed camera signs from junction 24 to junction 27 and obvious gantrys and speed cameras but yet you still flew through at 95mph?

Could you explain what you were thinking?

I’m genuinely curious and not wanting to argue but I see people fly under these cameras all the time whilst speeding and I often wonder what they’re thinking

Can't speak for the OP but....
I've driven that bit a few times and wondered if the camera's are only in use when the speed limit drops.

Which may seem stupid to think, but I saw this which implies that some cameras ARE only in use when the limit drops

Getting really fked off with this style of revenue raising.

I don’t condone the OP’s speed but I know 2 people who have had nips just recently, both just under 60 mph in a marked 50 Smart Motorway zone after 11pm.

ETA. Just re read my post & probably need to explain that my reasoning for being fked off is that if BiB had seen either of the people I know pass at their speed at that time of night a tug would have been in order to check the possibility of ‘Tarrant factor’ & either issue tickets or more likely a talking to.

I suppose BiB are more expensive per hour than a camera that just has an arbitrary limit set.

It’s just unnecessary. Makes me wonder about people.

Er ... the speed limit still applies, whether cameras are in use or not. 95 in a 70 isn't really excusable.

Are SAC’s per force? I recently acquired 3 points because I’d already done a SAC within the 3 year period. Offences with 2 different partnerships

Not sure that’s right. The poster you quote didn’t make any value judgement about ‘safety’ or ‘think of the children’ wrt OP’s speed, he was just rationally wondering why people take the risk of points and a fine.

And I think it’s a good question - why would you drive at 95 mph down a stretch of motorway that probably has cameras on it?

Next time OP perhaps use Waze with the speed camera warnings switched on... and pay attention to speed camera warning signs. Maybe consider doing some advanced driving with RoSPA or taking some time out with Reg Local off here. Best of luck.

I think you're correct (only one SAC in 3yr period) but I think in the past some people got more than one SAC if they were caught by different police forces.

Should be 3 points and a £100 fine. Just.

It won't be the ones on the gantry, it'll be the yellow hadex ones at the side of the motorway that got him, they're on all the time

I was told that those cameras were there to catch drivers going under the red "X" This enforcement is just coming in now with some drivers getting a warning letter.
