As per the title really http://www.bbc.co.uk/news/uk-england-london-436391...

78 year old man is cornered in his own home by a would be burglar (1 of 2 in the house), said burglar ends up being fatally stabbed after a struggle and the homeowner is arrested for murder.

How do we think this will play out?

Self defence so no further action... Or is that just wishful thinking?

If the reports are correct and scumbag had a screwdriver, seems a done thing.

Can any of us really say we would do different? If it was me, only difference would be that scumbag wouldn't have made it out the door, I'd have continued until he wasn't able to move and thus pose no further threat.

We will see how this plays out. The intruder had a screwdriver, a potentially lethal weapon, home-owner’s nearest object was a kitchen knife (attack was in the kitchen). An open-and-shut case IMO.

Don't think it is a Tony Martin type case, so the end result will be that he will be released after a lot of aggro.

As far as I am concerned, you go in a house to burgle, you leave your rights at the front door. No idea why he is in custody though, guess to avoid giving the green light to diy justice.

Agreed; suspect he was arrested as a formality as a person died as the result of his actions, but after they conclude their investigation you would hope they'd decide that his actions were warranted. In the meantime, stand-by for the scummy council FB posts of the loss of yet another promising footballer.

Hope the old lad gets through this ok.

Indeed. If there was another one in the house I would "possibly" be finishing one first before sorting the other, not letting a 2 on 1 scenario possibly continue if I could help it.

Once you break into a house that isn't yours you deserve all you get imo.

It should be made clear in law that a home owner can take necessary action against an intruder to protect his home - self defence should cover death if shown to be necessary force.

Why is the law protecting the criminals in these burglary cases - it's absurd.

Procedure doubtless means he has to be detained on suspicion for arse covering and because he might be fibbing.
If he is charged then that is a new game altogether.

General consensus in any event will likely be that the burglar had it coming. Fairly harsh penalty for burglary/attempted burglary, but if he hadn't put himself there in the first place he wouldn't be dead. And he wasn't an invited guest.

They aren't.
Self defence, including where necessary resulting in death is legal.
They of course have to investigate the circumstances to establish that is the case though

Good on the old geezer I say. Must be pretty scary getting confronted in your house by a pair of armed burglars in the middle of the night.

It does.

Arresting him for murder is likely a procedural necessity. Until they can establish his actions were proportionate it is the right decision.

Having been surprised by an intruder in my home I can say that once the adrenalin kicks in you don’t entirely have rational control of your body. This guy should be Let out immediately and the resources put towards catching the 50 real murderers across London this year.

This seems to be the fundamental misunderstanding. The law is, and has been for some time, exactly that. The force used has to be reasonable and if death results from the use of reasonable force then the homeowner has a defence to homicide.

I fail to see how the law is protecting a criminal. The bloke's dead. He's beyond protecting. What the police are doing is protecting the living.

If Alan stands with a bladed weapon in his hand and Kevin lies dead at his feet, then should the police just pat Alan on the head and send him on his way if he says, 'I used reasonable force to defend myself.'? Or, maybe, should they investigate the death and establish the circumstances surrounding it.

There may well be circumstances that we have no knowledge of. Such headings as: "'He deserves a medal': Neighbours leap to defence of pensioner, 78, as he spends second night in the cells after 'stabbing armed burglar, 38, to death while protecting his wife and home' " - guess the source - are there to sell space and are speculative at best and seemed designed to encourage anger and rage. The killer has spent 24 hrs in custody. He would have had an inspector review the circumstances and conclude that further detention is necessary. I assume, therefore, that there are reasons for continued detention, ones that have been explained to him and his brief. There are other possibilities.

I don't know what these circs are. The sub-editors of sleazy newspapers, you and the public at large don't know either. The police, the suspect and his brief know what these are.
