Mrs OB got nabbed speeding, 81 in a 50, no real complaints about that (rural trunk road link between M11 and A120, no schools or kittens nearby, and a short stretch of 50 between two 70 sections). I've been suitably supercilious towards her biggrin

Pleaded guilty on the nip, sent the paperwork off and waited for the fine. It came through, £1078 (Inc victim(less) tax). No mention of any points.

Seems steep, and a bit odd that there is no mention of points. Could it be an administration error on their part? Not that she wants to get out of it, she is OK with a fine but that seems rather large. It's almost at the point that a short ban would be preferable.

What say the masses?

Is it not based off your income now? Should be 1 weeks wages or something right?

Yeah that would tally, just about. Maybe it's right. Just seems fat when no insurance is £200 and I was caught at 63 in a 50 and got a £100 speed awareness course.

I would proceed cautiously, for the speed you say that would put her in band c fine and points.

Which is 150% of her weekly wage fine and 6 points. According to the telegraph anyway.

Something odd here.

Send off the paperwork admitting it was you and then it ends one of three ways:

1. Offer of SAC
2. Fixed penalty, 3 points and £100
3. Trip to court.

I don't recollect your scenario, there is no way she isn't getting points and how would they have any idea of her income anyway?
Is this demand in Nigerian?

Plead guilty by post can happen instead of 3 dependent on circumstances, so she must have returned the NIP and then some subsequent paperwork to make the guilty plea. The speed is in disqualification territory so that should be a court appearance?

FFS no it’s not automatically that level of fine.

It’s exactly as cmaguire states above. It’s only a fine like that if dealt with via a court, which the OP hasn’t mentioned, but was actually quite likely.

Points are a must too, so something isnt right at all with this.

My apologies for the confusion - yes the letter detailing the fine was from Mag's Court. We had already filled out her statements of income etc. The fine is closer to 100% of weekly salary than 150%.

She got a summons but as she was pleading guilty she did it all by post. I left her to it, she's a lawyer so (should) know more about it than I.

Would the points come from the court or separately from the DVLA?

Odd as I thought that 31 mph over the limit was ban territory ?
It got mentioned when I went to court for 79 in a 50 section, I got close to that in fines and 6 points.

I think with no points Roberta has got the best deal. Head down time, I think.

I'd consider that a result, pay the fine and move on.

You can’t get no points though, or rather you can, but only if she’s been banned. Im pretty certain she’d have to attend court if a ban was being considered. She needs to check the paperwork a bit more.

Better still, post it up here with the personal details redacted. I’m sure an expert will then have a view. It’s easy to post it with a smartphone camera.

She will have had to send her licence off with the paperwork in theory.
Go to the DVLA site and get her to do a licence check. I expect she will find she has 6 points or maybe 5, and they have omitted to tell her at this time for whatever reason.

I’ve just spotted the real piece of bait in this. The fine is bigger than the maximum allowed too for a non-motorway offence.

Is this a wind up?

I was caught doing 88 in a 50 last year.

Whatever indication of the penalty the initial letter gives ignore it!

I was summuned to court and managed to keep my licence but had to hand over the best part of £600 (This was pre-income based fines) and got 6 points.

This is PH ... remember that you're now satan for posting admitting you have been speeding.

The fine is for the offence only. The crappy victims' surcharge goes on top with any other charge I've forgotten

You'd need to see how the total was made up - it'll be a combination of income related fine (less discount), prosecution costs and victim surcharge.
