Back in February I posted that I had a NIP through saying I had been involved in an accident. I had dashcam footage and provided it to the police which showed a taxi was the car responsible and that I wasn’t involved. The police officer told me verbally that he wouldn’t be taking this further.

Today I was reading my insurance policy and noticed that I have this accident listed, and it states I was at fault. I’ve attached a screenshot. I’m shocked, I wasn’t called, emailed or written to by the insurance company.

Has this happened to anyone else? I’m worried that now we’re 3 months down the line they won’t remove it. Unfortunately the insurance company doesn’t have a call centre so I can’t speak to anyone to sort it out, I’ve sent them a message. I’ve also emailed the pc for a statement saying my number plate was mistakenly reported but I’m not holding out much hope. Any advice?

Basically Aviva then,
Might worth trying to call the parent company on 0345 030 7077 and see if they'll accept your reference number or at least pass you on to quote me happy.

Were they your insurer in January? How do you know they haven't paid out to the third party?

Yes they were my insurer then. I renewed in February and didn’t see the accident listed then. I presume they probably have paid out to the other party. But can’t beleive all of this could have happened without them informing me.

If your reported as involved in an accident, then it goes on your record whether there was a payout or not.

Ask the PC for a report confirming he was happy you werent involved, attach it the dashcam footage, send it all off to Aviva and ask them to remove the claim as you werent involved. Job (hopefully) jobbed.

Fight. And fight hard.

I was reported for failing to stop after an accident I didn't have. Some doofus in a BMW 3 series cab had a coming together with a car that was identical to mine at a post-traffic light merge from two lanes to one. I read the narrative of his statement, and can confirm I take a great deal of care at this particular merge point precisely because of the muppetry that goes on there.

Reading between the lines, I worked out that he'd pulled over, then when the other car didn't stop, he rejoined traffic and tried to follow them. Unfortunately for me, I'd passed between him and his 'target' and he took my number down and reported me. A common car (Vectra), in a very common colour (silver/grey metallic).

I replied to the Surrey Police letter stating I'd not been involved, they took no further action. My insurer backed me too, after sending an independent engineer to inspect my car. Doofus and his insurer refused to accept that he'd got it wrong and took it to court. The judge ruled in HIS favour. So don't presume that just because someone made a mistake, you won't end up paying for it.

Ironically, perhaps, I found a receipt for fuel that put me ten minutes or so behind the accident, but it was found too late for the judge to accept it as evidence. And several times after the accident (I don't dispute that there was a collision, just that I wasn't involved) I witnessed, on the same route, at the same time of day, a car identical in appearance to mine being driven in the most appallingly aggressive manner. No use reporting it though, as it would just be hearsay and presumption to try to pin the crash on him, and anyway, the court had ruled and my insurer had put the case to bed.
