Hi all,

Was in Ibiza a few weeks ago and just got a notification from the rental company that i've managed to pick up a speeding ticket whilst there.

Can anyone tell me the latest on if they have the ability to pursue now post some wonderful piece of EU legislation coming in to force?

In most instances, the speeding fine will be paid by the Rental Company, then they will charge the CC they have on file under your rental, and include an admin fee.

Unlikely you will even have a chance to have your say, unfortunately.

They’ve charged me for handing my details over to the Balearic Island’s Police but they have not paid on my behalf and in my experience they normally do not.

The rental car company have no idea who was driving, hence cannot just charge a credit card for an alleged offence.

Personally I would be have any admin charge reversed, at the very least the rental company will have to spend time justifying a charge, which they can never get paid for.

I thought in most cases, the 'admin' charge is in the terms and conditions of the rental agreement...?

This is getting dishonest.

You did speed

The rental co did bill the admin fee in the contract

I spend half my time in mallorca. I get the odd ticket. Record go bill be euro 45, the police write about 3-4 weeks later. You go on line and pay. If you dont the fine doubles. Speeding is e65 from memory.

Why take the risk ?? Will they chase you ? I don’t know but if you got caught surely just pay. It’s not expensive.

The rental car company have no idea who was driving, hence cannot just charge a credit card for an alleged offence.
No idea? Apart from the date of the offence, matched to the date of rental, matched to the Driver's Licence of the renter, and the Credit Card used for a deposit against the rental agreement, which will state on it regarding parking/speeding fines and that they are the renter's liability.

But yes, apart from all that, they'll have no idea who was driving the car.

I was in Sicily in November last year, I got a note two days ago from Avis saying that they'd charged me 42 Euro and change as an admin fee on the unspecified traffic offence that I would be contacted regarding by the carabinieri in due course.

Nothing from the Italian rozzers yet, and somewhat surprised at the length of time this has taken - half a year has elapsed.

No idea what the offence is, so waiting for that to materialise.

Took a year for Naples police to finally send me a fine for driving in a prohibited zone.

Sounds about right, I got done in Rome for driving in restricted area (fairly sure it was a bus lane) happened whilst I was looking for the hotel and it was the middle of night so no bus passengers were inconvenienced. Took 2 laps of the one way system and got done for both. Hertz sent through their invoice and took payment about 3-4 months later, they were good enough to refund one of the 2 charges when I pointed out that it was a bit unfair to charge me twice for "admin" when the 2 offences were 2 minutes apart, and it no doubt would have been the same guy doing the job.

The ticket from the Italian authorities took another 3-4 months to arrive. Strangely they only sent one ticket and ignored the repeat offence, so gracefully paid (mostly because we have a family flat in Italy and go around 4 times per year, don't want extra hassles. I already push my luck by not opting for the snow chains/winter tyres when hiring as the flat is only about a mile into the zone where required)

Ya wrong mate, why have a guess when you don't really know the answer, parking tickets yes, they will often pay them and charge you because they are the responsibilty of the hirer and they have all the details they need, speeding is a different ball game, just the same as over here, they need a confirmation the hirer may not have been driving at the time, there could 2 or 3 drivers all authoriseded to drive. so you will get a letter form the hire company telling you they have passed your details on, togehther with a nice little charge on your CC then it's a waiting game.

I got one a few years ago from italy, took nearly a year in the end to come from the police, emailed back saying how would I have a clue who was driving after a year and never heard another word

Challenge the admin fee before it's too late. In any case 42 Euro is clearly a lot more than the cost of passing details on, hence is a penalty. Hire car company can only charge what it costs, they can't profit from something like this.
