Traffic PCN. How long to reply to appeal?
Discussion
Hi all. I managed to incur a PCN for a traffic infringement caught on camera. My appeal was received by the Council on 31/01/2018.
As I hadn't received a reply until today, I thought that the matter had been dropped. They have rejected my appeal. I thought that there were strict limits on how long they had to reply.
I tried Pepipoo, but it won't accept my attempts at a user name, however unique I try to make it.
Thanks
Tim

Thanks for your reply. As I mentioned, I went there first, but I found it impossible to come up with a log in name that was accepted.
Most of the ones that I used were highly personal, so I concluded that there was a problem with the website.
I find it hard to believe that the Council could take three months to reply and the replies to similar questions seemed to back this up.

Good luck they are worse than the linch mob on here.
Unless you didn’t do what they are saying you did that is?
They will linch you and ask if you even know how to drive.
My friend didn’t realise in London they fine you for the most minor of infractions.
My friend got caught in a yellow box junction and they were pretty unpleasant so he paid it. The appeal took about a month so it bought him some time t pay for his holiday before coughing for the reduced fine.

In other words, your "friend" drove into a yellow box junction without being sure of a clear exit, possibly inconveniencing other road users and disrupting traffic flow, but your "friend" is special and rules intended to assist traffic flow don't apply to him, so he is aggrieved.
PS: the word you are groping for is "lynch".

Yes there were a number of issues with this non complaint but TfL approved box junction.PS: the word you are groping for is "lynch".
Outside of London we are are not hung drawn and quartered or fined and increditable £130 for such a minor infringement.
That fine is higher then a the one for using a mobile phone whilst driving until te recent change.

We pay enough for you to use them, why shouldn't we?
Classic "I'm a Londoner, I'm entitled".
Check your facts - London generates all the money to pay for your crude rustic dwellings and rutted cart tracks. You're welcome!
Classic "I'm a Londoner, I'm entitled".
I'm being generous here in my assumption that you actually pay any tax.

This thread is going the way of many recently. The original question is being side tracked onto another subject. Can anyone provide a definitive answer to my question?
Thanks

See what I mean!Thanks

What was the PCN issued for, and where?
It should also say whether it was issued under the Traffic Management Act, or Local London Authorities Act etc.
Some PCNs do have statutory limits, others are simply advisory timescales.
Thanks for the replies. It was under the local authorities act . I did see your post Rookie, but I have no idea what overall time limit is set for the process to be completed.
It seems a bit much that they can take that long to reply to me though! It was a restricted hours contravention.

In fairness it's not always as simple as that. PS: the word you are groping for is "lynch".
I hate (and I mean hate) taking an artic into central london.
Twice I've received penalties for 'stopping' in a yellow box junction. The problem is my 44t truck isn't as quick as a car. And it's a fair bit longer. So I do wait until there is a big enough space. And then a car (and in one case a police car) will go up on the right hand side and pull into my space before I have the chance to get into it.
When I'm just doing my job and those fines mean I have worked for a day for nearly nothing - I think I have the right to be annoyed. Obviously, I could be even more super cautious... and wait for a ridiculously big gap. But I don't think the cars, ambulances and buses behind me would appreciate this.

I'll need to check the exact wording when I'm back in the office, but I know it is 28 days to get an appeal in to them, and I think they have 56 days to respond to it. It seems a bit much that they can take that long to reply to me though! It was a restricted hours contravention.

I know the TMA only has operational guidelines, but there are some regulations that cover the LLAA.

As an aside, the legislation on box junctions state that it is "not permitted to enter a box junction if your exit is not clear" - however there are a number of successful appeals on record where the driver has proven that when they entered the box, the junction was clear, but they were cut up as you describe. Worth bearing in mind.
