Someone owes me some money, it was for work completed on a house. he has not paid and won't respond to me.

however now since checking, it appears the house where work was complete is owned by someone else, as his name is not listed having checked on land registry.

I have also done a check on 192.com, it does not show a residential address where he is currently residing.
It shows an address he lived in up to 2 years ago, I'm assuming this is his parents house.
also shows a commercial address (he is a car trader, seems legit and is FCA registered etc).
But also seems to buy and sell houses, however i don't think he buys them with his own money, hence not being listed.

I know his full name and date of birth.

If i was to issue a claim, what address should i use?

Or am i wasting my time, and spending good money after bad?....


Its only £700 owed, so not completely the end of day to write off, however would rather it in my pocket....

And would happily pay £60 odd quid to get him a CCJ and possibly cause him issues.


What do we think?

Only worth doing it if you have his address, otherwise any collection effort will be pointless and also he won’t even get a CCJ in his name.

Have you tried companies house?

Visit the house to see if he is there and if so ask for your money in person? Or see if they have a forwarding address?

You may be able to serve papers om his place of work..(see CPR 6.15)

I believe that you can serve the claim to the last known address, but when it comes to enforcement of the debt they would have a valid reason for getting it set aside - a more knowledgeable person may be able to confirm or explain in greater detail.

A CCJ would usually force some sort of engagement or discussion, but again only if it is applied correctly to his credit file. It may go for some time before it is noticed

As above. You will need to ascertain the correct address for enforcement purposes.

If it is £60, and it is one of those debts that narks you, send it off and it might get passed to them and trigger a reaction. If he's a ducker and a diver I would suggest it wouldn't worry them too much but if not it might start the ball rolling. I've used MCOL 6 times and once the official paperwork is opened, it gets the attention it deserves; usually!

What have you got to lose? apart from £60...

Use a tracing agent..... findukpeople did the business for me in a matter of hours and it wasn't expensive

Thanks Guys, MCOL wins again smile

I submitted The claim to an address (i think it was his mothers address, as land registry showed a 60 year old as owner) start of last week.

Yesterday i got a call from him stating he never received the invoice i sent several times, nor the reminder emails, the voice mail or the reminder letter. However he did however receive the MCOL letter.
He did actually sound genuinely surprised at the MCOL letter, so maybe he just doesn't check emails etc very thorough....

Anyway he said he would pay ASAP.

And just checked my bank and the funds including the court fee have been payed smile

Second time I've used it, and second time its worked successfully beer

Good result - and a bonus that they have paid up without the hassle of having to put a bundle together for a hearing..

Great result. Shows that the right bit of pressure applied can do wonders. I bet his old mum gave him a proper earful!! lol

I wish it had worked for me, in November 2016 I had the judgement in my favour as debtor owing me £650 never contacted the court , County court bailiffs seem pretty ineffective stating debtor refuses the to answer the door!!

After advice on here i engaged a company that uses Crown court bailiffs these are proving to be more efficient mainly because they have a financial interest debt is now £1,669.41 with charges but still not resolved.
