Hello

I was the passenger in a car accident back in November. The other driver although at fault has fabricated a story in which it was my driver was at fault. We say they changed lanes, they say we changed lanes. There's more to it than that but our insurance company believes there's enough evidence to prove our story is the true story.

Back in april we were told that our insurance was having to hand it over to their solicitors as they were getting no communication back from the thrid party insurance.

My question is basically what are your experiences in terms of time scale and how long is it going to take to get this all settled?

Can be years. Still waiting for a final result from a pretty minor prang 3 years ago.

It took me 5 years to get paid out after a serious RTA, I was a passenger. I hope you get a result a lot quicker.

I'm in year 3 of a severe injury claim involving the MIB. It's a pretty heavyweight claim but it's also perfectly straightforward.

7 months ago the 'next stage' was the intervention of an MIB instructed "accommodation expert".

I can accept that instructing an accommodation expert is a pretty complicated and specialised task requiring a letter of instruction to be written to one of the firms who carry out such work requesting them to contact me and make an arrangement for a visit. I can even accept that it might take some time for the MIB to headhunt and appoint someone who could write such a letter.

But SEVEN MONTHS?? To find someone who can write a letter?

Obviously there's a difference between taking your time and taking the piss.

Insurance companies are just khunts. And the answer to the OP is it'll take as long as they can get away with it taking.

More euuurrrgghhhh....

I have evidence showing that the TP story is make believe and thankfully our insurance agrees. I have another way of proving his story is all lies I just need to remember his address and go take a picture of his vehicle to show how the damage to our vehicle couldn't have occured from his story. Just a waiting game then.

Any stories where this hasn't taken several years?

I had a truck pull out on me at a roundabout, and despit full emergency braking I could not avoid the hit. I paid my £450 excess and got my car repaired. The case went on and about 9 months later my insurance company wrote back to my latest letter “Oh, yes, they accepted responsibility, year is a cheque for £450”. My insurance company would not have sent the money if I did not pursue it. No names, but I hope their red telephone has fewer calls.

I was rear ended while stationary at a pedestrian crossing, simple no argument case......think again.
My mistake was taking it all for granted, no photos, no witnesses etc. The other guy pulled a fast one,said I swapped lanes as I was pulling up to the lights,that sort of thing.
Two years later it was settled 50/50 in the small claims court !!!

What a TWfuriousT.

I did get rearended at a crossing once. Turned out the guy had no insurance so I lost my excess. The police couldn't find him to charge him either, partly due to the fact that they took so long in doing so he was already in prison for something else. FFS!

In an odd twist the third party insurance company has agreed to settle my case as a passenger "without prejudice". I get a cheque but the liability case isn't yet settled.

I had a car pull out of a junction in front of me, I missed him but hit another car.

I had four separate witnesses come forward. The police got involved and the driver of the car which pulled out was done for driving without due care.

It still took his insurance company more than a year after that to pay out.

Well not really that odd - you were a passenger so regardless of which driver was at fault you certainly weren't, so are entitled to compensation anyway.

Which party ultimately funds it isn't your problem!

I was hit and runned by a Transit driver who jumped a red roadworks light on a country road in Somerset - my daughter got the reg no as he raced off. He was either on his phone or pissed, as it was early evening and dark and my lights were on so it’s not like I wasn’t visible

Took two and a half years for me to fight it out with his insurer and get his admission of liability - will always get legal cover now, as couldn’t have got there without it
