Having an argument with someone who says contravening diagram 606 (vehicle must proceed in direction indicated) only carries a fine and penalty points in certain circumstances as stated in the traffic sign manual, chapter 3, part 2.3.
It states sign 606 when used on the centre island of a roundabout or at a junction with a dual carriageway shall be subject to rta section 36.

Rta section 36 carries a fine and points. Tsrgd 2002, section 2 states that section 36 of rta shall apply to 601.1, 602, 606.... etc

So which one is it?
(A) points and a fine for contravening sign 606 at all times regardless of where the sign is placed?
(B) points and a fine for contravening sign 606 only when placed on a roundabout or dual carriageway?
(C) A fine and no points?

Not all signs to which s.36 RTA 1988 applies carry penalty points or endorsement upon contravention.

Diagram 606 is one to which points & endorsement do not apply.

Oh, and TSRGD 2002 is no longer valid - it was replaced by a much changed / updated version in 2016.

Can you please give me a link or name of the two legislations to which you have referred to? 1. Which shows the points do not apply to diagram 606 and 2. The updated version from 2016?

As above, TSRGD 2002 was revoked in 2016. TSM Chapter 3 hasn’t been updated and refers throughout to the revoked regulations / directions.

Sorry for being thick but I don’t understand why the diagram 606 does not attract points?

The exact statement from tsrgd 2002 I mentioned earlier which listed the signs section 36 applies to seems to have been removed from the 2016 version or I can’t find it.

Firstly, you need to locate the relevant sign in the TSRGD 2016 Schedule and check which provisions apply (Column 6):



You then need to check Part 4 to see what those provisions represent:



This confirms s.36 RTA 1988 applies to a Diagram 606 sign. However, there needs to be an additional provision which specifies that Column 5, Schedule 2 of the Road Traffic Offenders Act 1988 applies to that sign - this is the section which provides that contravention of the sign carries points & endorsement.

Example - this is the same section which applies to traffic light offences: Note the extra bit which references RTOA 1988.



And this is the relevant section from the Road Traffic Offenders Act 1988:



No mention of that additional provision, no points or endorsement (despite it being a sign to which s.36 RTA 1988 applies).

Thank you for that. I understand now that provision 2 from part 4 needs to exist in column 6 but I’m confused about sign 612,613, 614 and 616.

612, 613, 614 being no left, right or u turn only has provision number 10 in column 6 and as I understand contraveaning these three signs alone does not result in points but so does the no entry sign (616) which I thought attracted 3 points. So where does it state that contravening a sign 616 attracts points or does contravening the sign 616 no longer attract points?

Also as per provision 10, if the no entry sign is not illuminated does that mean it is not legal/valid anymore and cannot attract a fine and points at all?

In TSRGD 2002, a Diagram 616 (No Entry) sign was subject to s.36 RTA 1988.

When TSRGD 2016 came into force, that ceased to be the case.

It was no points for 18 months or so, but the error was corrected in TSRGD 2016 on 18 December 2017.

Since that date, points and a fine could again be imposed for contravention of a No Entry sign.
