Hi, I was driving into a roundabout when i saw a cyclist racing towards me opposite, so i stopped because I knew he couldn't make it, so i saw him race across the centre and fall down, he then cursed at me for entering the roundabout as he had right of way, even though there was plenty of room to drive and turn right in front of me, i waited to se if he was ok and he kicked my car so i drove off and didn't think another thing about it. now i get a police letter claiming i was allegedly driving without due care and not exchanging details and stopping at the scene (even though my car was stopped the he kicked it?). I feel he was simply going to fast and panicked and fell and wants to blame me. even after he was about 5-8 meters to my right side, not even near me. What should I do? I went to the police and they told me to write a letter from my point of view. I am not that good at writing letters like this, can anyone advise some help, or someone who i could ask? i don't want to inadvertently make things worse.

Your description of the incident is not that easy to understand.

Can you provide a sketch or a google maps link to the roundabout, so that we can better understand what actually happened.

basically i entered the round about from a standstill but he was moving. I entered it slightly before him but he was going at speed so I didn't want to cause an accident so i stopped after a few meters because he was speeding up and I didn't want a collision. When I saw him come closer he looked as if he simply tried to brake as he was going very quickly and fell down further infront of me to my right. We were basically facing each other at the road about but he was travelling faster than me and fell off trying to avoid me very early on. I don't know why her fell down it was a big roundabout and there were no other cars about. He had the road to himself. He then was so aggressive I thought he would drag me out the car and punch me or something. He seemed fine so after he approached my car and kicked it from behind i drove away to avoid further kicks. If he wasn't travelling so damn fast there would be no problem. but his word against mine. he could have driven straight on also, but fell down instead?

you could say I entered the round about but stopped to avoid him hitting me as he didn't slow down.

Still not clear but it sounds like the cyclist was already on the roundabout when you entered, and you then stopped after crossing the line?

Id say we entered the roundabout at the same time but he didn't expect me to enter. Hence not slowing down on approach.

I think you really need to explain this to someone in person and get them to write the letter.

Although i guess it's been what, a week, so i suppose another cyclist vs motorist thread was to be expected at some point hehe

Cyclist at speed approaching a roundie. Op I guess didn't see him went onto roundie but then saw them, or misjudged who knows, but stopped. Cyclist braked as they thought op was going to hit him, and fell off the bike.

Akin to those people that poke out of mainroads when they clearly see you there.

I'd just do as the Police say and write a letter explaining everything from your point of view as best as possible. Make plenty of reference to the cyclists speed, how you were stationary long before he came off and how aggressive he was afterwards which lead to you leaving. Don't lie about anything but at the same time don't include anything remotely incriminating.

With no video footage it'll be his word against yours and with nothing more to go on what can the Police do....? Nothing, that's what!

no camera, no dash-cam, no witnesses.... good luck with proving something either way.

Strictly speaking, you may well be at fault - but then the cyclist should not be travelling too fast for the road/conditions (something motorists are usually very guilty of!) so bears some culpability.

unless he was doing 35mph+ that's going to be a tricky one to assert...

While OP is in the wrong for entering the rounadabout, why is it his fault the cyclist couldn't stop or go around him without falling off?

Seems like he's a st cyclist and OP is st at roundabouts.

He fell off by himself?

I'd say the cyclist may have had to take avoiding action, but himself was going too fast to be in control.

Your discription isn’t clear. At all. Don’t write to the police until it is.

Roundabout or mini roundabout (he went over the centre)?

Who entered the roundabout first (you should give way to traffic already on a roundabout, or traffic coming from your right)?

Your entrances were opposite each other? Which way were you both going? We’re you both signalling such?

Show us a google map.

Op will shortly be informed by one of the usual militants that irrespective of any facts the cyclist is never in the wrong. (Even when it is one of them driving the car, all other road users are still at fault)..

This is because they are vulnerable and it was decided at a cycle club that everyone needs to revolve around them as if they are 'special'.

Later on I predict that one of the more militant members of that religion will declare that nobody has yet mention that cyclists don't pay tax. This is just normal rhetoric for them as they constantly get upset that nobody else ever mentions it first anymore.



The corret advice is to respond to the letter and tell story exactly as it happened for your perspective, but don't be surprised if the cyclist has been totally fictitious in their own accounting.

I’ve not got a clue from either of the OPs descriptions what actually happened, but wonder what the road/weather conditions were like at the time.

Rightly or wrongly the cyclist will have assumed/thought that the OP was going to stop at the line but then saw a car cross the line so had to brake more suddenly than conditions allow, last night the roads were really slippy were i was riding so a sudden and unplanned braking could easily end up in an off, right side down....... decent bike landing hard on power pedals and electronic gears there’s and easy £1/2,000!
