Get the s.172 notice to him. He completes it saying he doesn't own the vehicle, he doesn't know the vehicle and (if it was the case) that he couldn't have been driving the vehicle because at the time of the alleged offence he was being entertained at HM's pleasure.If it was someone who nominated him, the matter should revert back to that person.

Re-read the OP. It's not stated that he was inside at the time of the offence, just that he is now. The belief is that somebody's nominated him since they don't think he can respond due to his recent change in accommodation.I'm not seeing anything that says it definitely wasn't him, just that his family think it probably wasn't.

Wasn't that clear (certainly not from the thread title) whether he was or wasn't - hence the addition of 'if it was the case'.Irrespective where he was staying at the time, as a person other than keeper, the s.172 notice places an obligation upon him to provide any information which is in his power to give and which may lead to identification of the driver.
In short, he needs to tell them whatever he does know about the vehicle & the incident, even if that amounts to 4/5 of nothing.
