Cloned plates and a parking fine

Hi guys first time posting sorry for the essay you’re about to read

I have just had a letter through from UKPC about a parking charge from 12/07/18 from a car park I can categorically say I was not at and have never been at in my lifetime. I have texts from my partner at the same time and date confirming I was in my parents house looking after it while they where on holiday, however I know this wouldn’t really be useful as any evidence.

Upon closer inspection of the pictures issued by the parking company I have noticed that the screws that hold the number plate to the car pictured are in different places than on the number plate of my car, also the quality isn’t the best but I can’t see any postcode or company name on the pictures on either the front or rear.

Also 3 days after the parking offence was commited I was pulled by police in a matrix van on my way home from shopping as they told me they had been briefed that morning that the car was reportedly on false plates, after a talk with me and checking the vin number they confirmed that my car was legit and not stolen or on false plates. At the time I didn’t think anything of it as police pull me quite frequently due to the type of car being stolen often and my young age.

I’m just wondering if the following points would be enough evidence if it went to court and what’s the likelihood of the company folding and backing down if I provide this information? I can post pictures up for you to see if that would help anyone get a better insight.

Thanks in advance for any advice

Write to UKPC explaining all of the above and asking for their invoice to be rescinded. Include pictures of your number plate for reference. Tell them you consider the matter closed, and to stop processing your personal data. They'd be mad to go take it any further, but if they do, you'd easily win in court. At that point, you'd probably even be able to counterclaim if they continued using your personal data.

A friend of mine recently went through something similar.

Silver BMW that he owns was sent a parking fine, he lives in Devon area the offence was in Essex, on closer inspection the BMW was quite a bit different wing mirrors different colour, bumper was from a different spec level etc.

He provided evidence. In the mean time he had posted in a local group on Facebook to where the offence took place and numerous locals posted pics of the car on about 5-6 different reg plates.

The parking company accepted it.

I think the police pulling you might be enough in this case.

If you got time to kill let them take you to court , might be a fun day out watching the scummy parking company lose money.

This ^^

Outside of the small morsels of good advice, the only thing you can guarantee on here is bad advice from people who hate the parking co's so much for catching them, that they wish you to punish them on their behalf.
They wont care if in the process, YOU are risking a greater fine or a unpaid time for a court date you never needed.

Write to them. Including something tangible from the Police about the cloning if you have it.

You weren't there, you didn't break the rules and can prove it, - so do that.

Let the scummy parking company spend some time, money and effort chasing you first - then tell them wink

I've had my fun with a private parking company when the cause of the problem was a systematic computer error on their behalf but in this case, they've been hoodwinked as much as you. The car on the false plates has caused both of you the same grief; for once, you're on the same side as the PPC. I'd let them know that the car's on false plates and only decide to "have fun" if they were being unreasonable or ride in response to that.

OP

Ignoring the plate problem. have a quick check on pepipoo on the dates involved Alleged parking infringement....date you were first notified....was there a ticket on the windscreen? It looks like over 56 days from infringement and somewhere in my brain i think that is the line in the sand for them

They may be out of time in sending you this

so you can nail it by just writing back saying they have not complied with the law

Don't do this, keep it simple and relevant. The car was not the OP's car, that is the argument. Getting into the sort of discussion above confuses matters and takes emphasis away from the key fact that it's not the OP's car.

there will be more and more of this as they force us all into this big brother changes and control.

Particularly around average tax cameras.

Less and less police to pull you over, and more automated cameras - will mean cloned plates.

It's a nuisance but I understand why the crime is being committed.

Surely it'd never get there. Doesn't all evidence intended to be used in court have to be given to the other side prior to the case being heard? So they'd know that you'd already been stopped by the police because of a false plates marker and that you checked out. At which point they'd just give up with some nonchalant letter.

Most likely you’re right but I like to put the bar stewards to maximum inconvenience.

This is a really stupid idea. Don't do this. Spend time on some clever website to determine whether or not the ticket is invalid in some way. Send that to the parking company and then be almost certainly wrong about it. What on earth for when you can simply and provably say, not me guv. Unbelievable.
