Bit of an issue with the right of way that leads to my house, several other houses and local businesses. These are all accessed via a single track road which at the top of it, is a window company. Every Friday they have a delivery of window frames etc that arrive on the back of an artic truck. They back said truck down the road, thus blocking access to and from the properties and businesses. The lorry arrived this morning earlier than expected at 8.25 and I was stuck behind it until it moved at 8.50. Also held up was our neighbour, a builder, the postman (who couldn't get access to 5 houses) and customers of two of the businesses
I tackled both the business owner and lorry driver who refused to move and would not change the drop off spot to a more convenient spot, literally around the corner. So my question is, how do I fare from a legal standpoint? Can they block a right of way for an what most would consider to be an unacceptable amount on time or is it something that we have to suck up and deal with?

how long has the business been there for?

The window company has been there I guess 3-4 years. The body shop which is one of the affected businesses has been there for 30+, the second affected business has been there about 4-5 years.

Pics? Are you saying they are at the beginning of the road and everyone else are further along its length?

This is the view I had for 25 minutes. The window company is at the head of the road, so by unloading where they do, they are blocking access for everyone.

The first complaint should go to the delivery company ,say it is unacceptable to block the road at any time

and that they could unload around the corner.

I did try to tackle the driver but was greeted by abuse. I am not sure who the actual delivery company are but I am off work next Friday so can make sure I am able to find out. While I appreciate people have jobs to do and such like, I just do not feel it acceptable to cause such hold ups at what is the one of the busiest times of day

Isnt blocking a highway a Police problem? I know the usual answer to a knackered old car outside someone's house on here is "drag it into the road so cops get involved"
If it happens again, dial 101, see what the Police can do. After all,what would happen if an ambulance had to get past?

I had thought about police intervention, but wasn't sure if it would be a police issue. If the same happens next week, I will do just that and call 101.

Next week get there early and park your car in a way that prevents them unloading their lorry and fk em tank

Well the road is not fully tarmac covered. The area is very much slap bang in the country. My house and the immediate neighbour are surrounded by fields, the other 4 houses are also not really overlooked by anything. There are only 3 businesses in total, the window muppets, a small car body shop and a larger independent car workshop. I would say the term "road" is loosely applied here!

Is this an access through an industrial estate with tracks leading across a railway & then to houses & other buildings.
Just off the A5 Holyhead Road to the east of Gaerwen & a little further east past the A5152 roundabout? (Internet search 'Gaerwen map' & then select 'aerial view', if I'm right it's on the same estate as Parry's furniture)

As an ex driver who sometimes blocked streets because I REALLY had no choice ,I would never verbally abuse someone

if they were being reasonable with me and I always felt bad about blocking the way.

The name of my employer was all over my truck so it wasn't hard for them to get straight onto the boss.

Let's see how apologetic he is next week when you block his lorry in and make him late for the rest of the day. Bloody ignorant ahole.

If I’ve understood you correctly, the road is and private* and ownership is shared between the various property/business operators or owned by some parties with others having a legal right to pass and repass along the road. If that’s the case, then I think you could jointly or individually pursue a civil action against the offenders to enforce the right of way unencumbered. If it’s private you might well find the police won’t be interested from the obstruction perspective but only in respect of any possible breach of the peace etc.

It’s a stty situation to be in and hope you get it resolved soon.

  • rather than public - ie adopted as a public highway and maintained as such by the local highway authority.

Most likely if you dial 101 you will be on hold until they've finished unloading. The correct number for a crime in progress is 999, but obstruction of the highway will be graded as not particularly urgent and you'll receive a phone call from a PCSO the following week.

Don't call 999 to report a delivery wagon causing an obstruction

a) it won't result in someone attending any sooner
b) it may delay someone who has to report a real emergency
c) it makes you look a bit of a dick
