Empty car with engine running.

I was out today looking around some garages for a new car. I came across one garage which was closed but had some interesting looking cars so I stopped to have a look around.

The garage was on a main road just on the outskirts of big town. The cars were parked on a forecourt which had no fence or posts, one of the cars at the very front (£16K) was all unlocked with the engine running, it was keyless ignition so i can see how'd it could have been left on.

I looked around for any staff but it was all locked up, I tried to ring the garage on numerous numbers but no luck, so I just turned the car off shut the door and left.

It got me thinking, where would they stand if someone had have jumped in and taken off in the car?

It would be TWOC or theft depending on the drivers intention.

The garage would be the victim and although possibly daft to leave the car in that state, wouldn't be at fault...

Though their insurers may not see it as such?
