PI claim and 50/50 insurance?
Discussion
As if the current ongoing fraudulent injury claim at work isn’t enough we now have a second to contend with.
First one we have to accept full liability, old man nudged a car at 2mph after not being able to stop in the rain in his 8month old Navara. Incidentally it went into Nissan for a service and a brake fault was discovered meaning rear bias was minimal/none... good luck proving that though. Anyways damage to new Navara amounted to a cracked number plate around the screw, and not a single visible mark on the other car, not even a scuff. Never the less the victim was off work for days on end with soft tissue damage behind the eye, and in a courtesy car naturally
Incident number 2 less clear cut and the right hand lane immediately after the roundabout was closed as signalled for the previous 800 yards. Our driver was in the left hand lane going straight on and a new Evogue was in the right hand lane also going straight over (to the non existent closed lane). Our driver maintains he didn’t straight line the roundabout and she tried to barge passed him and then had to brake hard and tuck behind him catching his right rear quarter when she ran out of road, today we get yet another PI claim stating he cut her off and collided with her (remember her lane was closed). Of course with the claim comes the standard PI claim for soft tissue chest damage and 4 days off work and again a hire car. Photos of damage shows a 10cm white line on our van and a scuff around the same on her NS front wing, you would have to zoom in around 400% too see it though !! When did people become so ‘fragile’ ?
Anyways I digress , the last one is less clear cut for insurance I would imagine with no witnesses who came forward and the typical he said/she said. If it goes 50/50, what happens with her PI claim ? If her insurance pay £50 for the smart repair on her front wing surely they won’t want to pay for her being in a hire car and ‘upto £10 000’ in injuries when there is blatantly no damage ?
No wonder the honest ones get fleeced every renewal

The hire claim and PI will be an uninsured loss so won't be covered by her own insurance.
If liability is settled on a 50/50, she will only recover half of the damages for her PI claim and half of the hire charges.
Thanks,If liability is settled on a 50/50, she will only recover half of the damages for her PI claim and half of the hire charges.
So the half she does recover will be via our insurance?
Cheers
