Do I join the VW litigation?
Discussion
Hi all,
Heard quite a few adverts on radio in the last few days for this particular company
https://www.vwemissionsaction.com
It’s slater and gordon solicitors , they are offering people the chance to join a group claim against VW for the emissions scandal if they current own, or have owned an effected vehicle.
My 1.6 TDI touran is affected and has had the ‘fix’ by a VW main dealer. They are suggesting they will attempt to claim half the vehicles value as compo and suggest that they’ll take 30% commission for representing you
Any catches to watch out for? I’ve had a quick scan of the FAQ and it suggests the action is funded by an idemnity setup meaning if VW successfully defend their case I won’t be jointly liable for any legal costs so can’t really see a downside but I’d appreciate any advice
Thanks in advance

So how much have you actually lost financially as a result of VW's emission "cheat"?
Call me old fashioned but doesn't integrity and honesty count for anything? If you pay a premium price for a blue chip brand then surely you don't expect to be treated as a mug and have the law/rules blatantly abused by said company. VW deserve a massive fine form every country where they knowingly and deliberately broke the law.I don't think there needs to be any particular financial loss to the consumer; just the fact they have been willingly mislead is enough in my view.
Else next time I get fined for doing 33 in a 30 zone I could just say "hang on HMG you haven't actually lost financially, I only broke the law so why you fining me?"
(PS I do get your point but for me there is a higher moral issue here).

Sue them, then post your details up so the rest of us can sue you for driving this "obnoxious" car and putting us all at risk. Heard quite a few adverts on radio in the last few days for this particular company

That question baffles me. Who wouldn't get money out of VW if they could?MikeStroud said:

So that'll be the US, then.Polite M135 driver said:
I’m very unclear why the UK government hasn’t acted to penalise them.
Because they didn't get caught breaking European emissions testing laws. Only the US laws, which are very different and a hell of a lot stricter.Does anyone actually believe all the marketing hype in the first place?
Surely one should only be suing if one has lost money either because you have bought a car you wouldnt have bought if it wasn't for the claims, or the car you bought is worth less as a result of the claims?
The courts are going to decide on the element of loss suffered and lawyers here can hopefully advise how that is calculated. I'd be surprised if it is anywhere near 50% of the vehicle value though.

To join the group action, did you buy your car before 1st Jan 2016, that is the cutoff to be able to claim? If you bought a car after that date then they assume that you would have been aware of the problems. I bought mine in Jan 2017 and can't claim.
Take a look at their FB page https://www.facebook.com/groups/SlaterGordonVWEmis...
Also https://www.facebook.com/groups/emissionsscandal/
Their are only 19 days left to join the group action.
