Hi all

One of my sales contractors is leaving us on Monday (on good terms), and he has asked me if i will agree to him downloading a copy of all his work emails and keep a copy. I am not sure why he has asked for this but i find it slightly odd, as I have never had anyone else over the years ask for this when they leave. He is self employed and pays us to oversee his compliance, administration, marketing and uses our brand to work through. He wont be taking any sensitive information with him (as far as I know).Are there any potential issues with allowing him to do this? Legally or relating to data protection?

Firstly GDPR prevents you disclosing data to non employees. He is no longer a employee so you cannot legally do so.

Secondly, he wants you steal your contacts / data from you, Having lost £200K in a similar manner, never let anyone take anything from your business.

He's decided that he doesn't need to share the money with anyone else, is setting up on his own & wants you to give him a list of all your customers he's had dealing with.
Probably realises he's cocked up by not keeping copies in the first place.
If you let him have them they will likely receive a message from him letting them know they can deal with him direct & for less than you charge.

There's certainly an issue relating to data being released to him without the consent of the third parties it belongs to, but as people have already said, he's probably snatching your contacts, and likely already has but wants your permission to cover his back.

Thanks all for your input-I do think GDPR is the concerning point.

With regards to contacts, I think it would be the other way around if any-we have and must continue to keep a copy of all his clients and contacts in the tightly regulated industry we work in. However, with all leavers I have ensured that it states in the contract that we will not solicit these.
