Recently a bypass has opened near our house. The "overbridge" is designated for farm traffic and foot traffic only. However people are using it for general access in their vehicles, both private and commercial. The only people supposed to have access are the 70 year old farmer and next to us and we have been fighting their corner to get this road correctly barriered off. Traffic up and down our single track road is ridiculous with people tearing down at 60mph and generally causing a lot of noise and hazards.

Currently there are two broken bollards that anyone can just put down without needing the key. We keep putting them back up as well as replacing th comes that get moved. See pic link at bottom.

I have been in contact with several businesses who use the bridge and have even had to confront people in person to ask them not to use the bridge. Of course this has had mixed responses. Generally hostility over being told to find a different route seems the common response. Especially from a dog walking company nearby.

Until the road builder or council man's up and installs a proper barrier is there any point in trying to discourage the people using the bridge? Of course using it contravene the road traffic act and puts the foot traffic at risk.

No, only the bollards at the moment. But they're so easily bypassed as makes no difference.

The question is who paid for the overpass to be built?

The same problem arose here but it was an underpass that was meant to be for farm use only except not using it means a mile detour so naturally it gets used a lot.

The argument was put that as the council paid for the underpass it could hardly be for the exclusive use of the farm.

You could argue that the public paid for it all. However, they were supposed to be installing a full lockable gate that the farmer had access to.

The bridge in question is C34K listed in point 4.4.39 in the document below.

Yes it's Aberdeen. Need to update profile. Aberdeenshire council doesn't take up ownership of the bridge until April unfortunately. Will see how we go with the company rep from AWPR first I think.

Not really. If the by-pass blocked off a private track, then a replacement is usually made (which is still private, or at least restricted).

What does it show on Google maps ?

I mention it as my father's farm drive was shown as a road - a quick report to Google and it was corrected in hours and the problem solved.

Obviously you may still get the odd local but in our case it was just people blindly following satnavs

April IF the rest of the bypass is open and various other criteria are met. It may be the case that while the council take 'ownership', it may continue to be the contractor who is responsible for it for some time longer, depending on negotiations that are currently ongoing.

Park the tractor in front of the bollards to block vehicular access? You'd probably only have to do it for a week or two before they got the message. I presume it's all people with local knowledge that are doing it.

A big old farm trailer might be a better idea. Less opportunity for an annoyed commuter to exact some vandalism as revenge.
Every farm I've been to has a rusty or manure-covered hulk parked up somewhere that could be used as a not-very mobile barrier.

another vote for get the farmer to park something in the way, hes the only person supposedy accessing by a vehicle so he wont commit an offence by doing so as long as he leaves pedestrian access.

Sounds like you don’t like it (are they really going up your lane at 60 mph? )

Calm down dear.

Clearly other folks find it a useful route. You don’t own that bit of road so it’s not your job to set up a roadblock.

That's not the point though is it?

First question is is the lane adopted as highway or not - that could lead to some very interesting situations. If OP owns the lane he talks about then there might be an option of gating that - subject to legal rights of way that might be in existence.

It should also be considered that the OP might be very happy with the farmer driving by a few times a day and so did not put any objection or representations in. Now the constructor seems to have not yet done part of the security works meaning that the OP has people coming by that it was never envisaged would do so.

I can think of lots of things that others have sole rights over, or at least that i have no legal ones over, that would be very useful to me to be able to use. Doesn't mean that i am entitled or even right to do so.

Sorry can't help you OP (also in Aberdeenshire) but the AWPR has been a shambles from the start and still is so unfortunately you are prob bottom of the list of things to do/fix etc and my guess is they will say the bollard are fit for purpose and no gate needed....they are £400mil in the red after their bridge F up!!!
