It’s insurance renewal time and just running through my old comparethemarket settings I noticed the wife had some old points. When I mentioned it she was adamant they were from December 2014. Still valid for insurance but for some reason on my current policy I have the date as Jan 2015 and her current policy as Jan 2016. I’m guessing I just clicked the wrong date on hers when transferring from mine.

I logged onto the government driving licence portal to try and clarify the date so I can change it with the insurers but the points aren’t showing at all... is there any way I can find the date out and if not, then how do I tell the insurers when it was?!

Might be wrong, but if the points aren't showing on the DVLA check system then they're expired and don't need to be declared.

Some insurers ask further back than the valid duration of most points. This is why the OP needs to figure out the original dates.

The DVLA system will show all points, not for their totting up period, but up until their expiry under the Rehabilitation of Offenders Act (5 yrs for speeding). If they don't appear on the system, they are outside the RoOA, and don't need to be disclosed, regardless of insurers request. The RoOA trumps the insurers right to know.

3 years for totting up
4 years on your licence
5 years usually declare to insurance

Interesting link. I just looked at it and my 3 points have 'expired'. Nothing was ever put on my physical licence so do I need to declare these anymore or maybe not. can insurers see my licence? The Act mentioned above is interesting.

As most insurers ask for a 5 year history as they are legally allowed to do (with regard to the Rehab act), then you are required to disclose the points up until 5 years. Whether you do or not is up to you.

The 5 year period has nothing to do with the points. It refers to the endorsement on the D/L.

How do you mean it has nothing to do with points?

To me it applies to points(which is an endorsment under sheduel 2 1988) unless a critera is in force to accept a rehabilitation at less then the 5yrs.






Can you explain please?

Seems unfair that you need to fess up a 34mph speeding ticket for 5 years, but steal a car, run over a copper and do 3 months of bird and you are "clean" again after only 3.

Many thanks, wonder when they lapsed, guess it doesn’t matter too much as long as I don’t have to declare them come renewal...

The tricky bit is, they are declared as two different dates across our policies both with LV... what’s the bet I wouldn’t get a nice rebate if I tel them I’ve made a mistake and actually there are no points valid at all!

Nah, you'll probably be charged an admin fee for making changes to the policy mid way. They'll also find you're in a higher risk category now and be expected to pay a top up premium and if you don't you'll get your insurance cancelled. Then they can charge you more next time you need a policy. biggrin

On the .gov sight my points are gone since they are 58 and 59 months old (2x SP30).

Since the 5 year rule exists for insurance, I’ve declared 6 points in the policy I’ve taken out this month. I will call my insurance when all point are over 5 years old and see what they say.

If they take it into account and lower my policy, excellent. If the do the above but charge me to “change” the policy it depends on how much it costs/net save.

If it’s a p**stake charge, I’ve got a 15 years NCB, keep your 2 months on cover, I’ll start again elsewhere for 16 years!
