Ex partner causing misery
Discussion
Will keep this brief as I can. My sister is having countless issues with her ex. He is a mental health nurse that has previously been sectioned and has ongoing bipolar issues. He constantly calls social services on her new partner, openly admitting that he is doing it to drive him and her apart. On the latest Social service report they mixed someone else's case up and it stated in there that my sister had guns in the house! He is nasty controlling b
d and has sent this confidential report to all her family, friends, mothers down the school. She has come to a dead end of what to do. Social Services have previously asked him to stop wasting their time but he is relentless. The latest social worker has said she thinks he has a Narcissistic personality disorder.
She phoned the police about this harassment and him sending out the confidential report. the police reposonse was a bit pissy, they said they would nip round his house and have a word.
Can she demand they press charges?
Is it illegal to send a confidential report out to cause distress
He works for the NHS, anything illegal about sharing confidential stuff.

Solicitor. Get it done properly. Legal aid is available in some cases.

If you have evidence of him sharing confidential info, you can most likely get him struck off the Nurse register - meaning he can no longer practise as a nurse:

Restraining order and / or moving away.
How did he obtain the confidentual report? If he obtained it by (misusing) his computer access at work then that is criminal offence which his employer would definitely need to know about and investigate. Can you prove that he sent the report to the people?

I’m guessing theres kids involved - is he the father? Does he have any time with them?
My advice would go for a non-molestation order. Fairly simple to put in place and the kids can be included on it if needed. If he breaks a non-mol order the police have FAR more to go on by way of ‘speaking’ to him.

You can't "demand" that the police press charges, it's their and the CPS's decision - but you can and should continue to report every incident, tell them what action you want them to take and request a crime reference number for each incident. Can she demand they press charges?

Sending malicious communications by post, email or whatever with the intention to cause distress is a criminal offence.
Not sure if publicising confidential NHS records is a criminal offence, but as above it's a serious breach of the Nursing and Midwifery Council's code of practice and potentially grounds for striking off.
Also as above, his employer very much needs to know - he's a mental health professional with apparent serious mental health issues himself.
As above once more, don't DIY this, if people's welfare and potentially safety is involved get proper professional advice.

Sharing of confidential information may be something the Information Commissioners' Office may be interested in.

I'm not saying don't do this - but think carefully about the possible ramifications of "being responsible" for terminating his career in addition to the grudge he already has.https://www.nmc.org.uk/concerns-nurses-midwives/co...
